Show USED A SHOTGUN TO HOLD GOVS EOR OFFICERS B. W. Cole and Don Colette, arrested last evening by deputies of the sheriff's sher-iff's department on a complaint sworn to by Murray K. Jacobs of Riverdale, for destroying a eherry tree by breaking break-ing off limbs, were found not guilt Of tha charge this morning in the city court and were released. Evidence was introduced to show that the boys had been stealing cherries, cher-ries, but sufficient testimony was not given to convict them. According to the story told in the police court this morning, the two boys were caught in Mr Jacobs' orchard or-chard stealing cherries. Mr. Jacobs held them foi the arrival of the sheriff's sher-iff's deputies who placed them under arrest. To hold the boys from running away, it was brought out that Mr. Jacobs Ja-cobs used a repeating shotgun Mr. Jacobs testified this morning that the boys had broke limbs from a cherry tree and had partly destroyed it To this the boys presented a strong denial and they were upheld in their testimony by two girls who were with them. Judge Roberts, in ordering that the boys be dismissed stated that had any substantial testimony been introduced by the state proving that the boys had broken limbs of trees, the penalty would have been very severe. |
