Show II PACIFIC TO BE GIVEN EASEMENT FOR HO This morning city Attorney Valen tine Gideon reported to the city board of commissioners that, inasmuch an Poplar avenue has been used as a public thoroughfare the past 20 years, the city had acquired jurisdiction and control of it as a city avenue for the extension of watermaln?, grading, paving and all other improvements deemed necessary". The report was made at the request of the conimls sloners in the consideration of a petition peti-tion for the extension of water mains The avenue had not been dedicated to the city for street purposes and it was a question with the board as to whether tho municipality had Juiisdic lion ' - .Mr Gideon also advised the com nussioners that the circuit court of ili'1 1'nitod States had rendered a decision de-cision in which it is declared that the Union Pacific company is the rightful owner of the waters of Taylor canyon can-yon and he rerom mended that a stipulation be entered into betwoen the city and the railroad company pro- j Tiding an easement over city property I for the operation of the company's pipe lino. Mr. Gideon was authorized to enter Into the stipulation in behalf of the city. It was reported by the attorney that the company is willing to pay (500 I for the right f way. and he consider led thai it was a fair price for the easement The water right question ques-tion has been in the courts a number of yeais. oo |
