William Waldorf stor was defendant today in an action ac-tion before Justice Rowlatt In the aigh courts brought by Mrs. Alice Alexandra Al-exandra Falcke of Green Cottage, Kineton. Warwickshire, who sought :o recover payments in arrears under in alleged agreement entered into by Mr. Astor and herself for the support 3f her child, of which Mrs. Falcke "latins the expatriated American mil ionalre is the father. C-, who was appearing tor Mrs. Falcke. following which it nas announced that the ease has been settled subject to certain details be-ng be-ng worked out The case was then adjourned until the first day of the next court sittings, sit-tings, but counsel announced that the court was not likely to be troubled with the case further. It seems that about five years ago Mr. Astor became acquainted with the plaintiff, who was a beautiful young woman, then unmarried friendship followed which ripened into great af fectlon. A child was born to Mrs Falcke and then came the estrangement estrange-ment due, it is alleged, to Mr .Astor objecting to being registered as the child's father. Eventually the young mother gave way on this point in consideration of Astor agreeing to pay her $10,000 a year in quarterly payments. Since then the young woman has married and Astor, for some reason, refused to continue payment- Hence the present suit which was to recover re-cover $25,000 arrears The defendant is described in the rourt -papers as "William Astor of the Astor estates, offices Victoria Embankment. Em-bankment. London." Both he and Mrs. Falcke were in court today, the latter being heavily veiled, in spite of which it was easy to see that she was a very beautiful young woman Astor, gray-haired and debonair, sat with his famous counsel The plaintiff's statement of the claim read "In or about the month of September, Septem-ber, 1910, it was verbally agreed by and between the plaintiff, who was then a spinster, consenting to remain In Paris with her child, of which the defendant is father, and abstaining from registering the defendant as father fa-ther of an illegitimate child, and in consideration of the plaintiff from abstaining from starting proceedings :igainst the defendant in respect of the birth of said child, and in consideration considera-tion of the plaintiff taking charge of and maintaining and doing all things tor the use and benefit of said child, and taking the responsibility, the defendant de-fendant would pay to tho plaintiff 500 pounds on the first day of Jan- B uary, April, July and October of each 3 year. The defendant has failed In 1 paying any of the sums clue since Oc- toher. 191 L and the plaintiff claims f under the agreement accordingly " In his formal defense Mr Astor denied de-nied agreeing to pav the plaintiff the 1 alleged or any Installments. He ; denied that there ever was any agree-j agree-j ment, and said that never had any consideration been given at all After a consultation between coun- scl. Sir Edward Carson, advising Justice Jus-tice Rowlatt, said: "I appear for the defendant who has practically arranged the case subject to certain details being worked out If It suits your lordship's convenience , you will let the rase stand out un-til un-til the first day of the next sittings. It Is very likely that you will not hear of it except I make a formal application." The court agreed and all parties left. |
