Show IAJ HILLSTROM CAINS STAY FROM DEATH Salt Lake, Sept 1. Motion for a new trial for Joseph Hillstrom. convicted con-victed of the murder of J G. Morri son, was denied yesterday afternoon by Judge M L. Ritchie of the district court. Papers for an appeal to ih supreme court are prepared and will be filed Immediately, thus Btaying Hillstroin's execution, which was set for tomorrow. Soren X Christensen, who entered the Hillstrom case at the middle of the sensational trial last June, argued the motion for a new trial. The district dis-trict attorney. E. O. Leatherwood. opposed him, declaring Hillstrom had been duly tried and convicted and should pay the penalty without further fur-ther ado. Attorney Christensen con tended that the state had failed to establish the identification of Hill strom as the slayer of Morrison. He also touched upon the incident wherein where-in Hillstrom arose In the courtroom and discharged his attorneys, Scott and McDougall He said that such an episode undoubtedly effected the trial and argued that the retention of the discharged attorneys as "friends of the court" prejudiced the prison er's case. Christensen declared that Hillstrom did not have a fair trial. "When I entered the case and took one glance at the Jury I knew that all hope was lost." he said. 'That jury was selected by a science at which the district attorney is a past master and the defendant b attorneys were unskilled." Since Hlllstrom's conviction scores of letters, threatenlug and iraportun ing, have been sent to the governor, the county attorney and the district attorney, asking that Hillstrom be given another trial.
