Show SUIT OVER THE I OPENING OF AVENUE I In the district court yesterday af-ternonn, af-ternonn, Edgar Jones. John K. Spiers and Louisa Curtis HoutZ commenced Injunction proceedings against Ogden City to prevent the municipality from collecting taxes for the opening or Hudson avenue, between Twenty-fourth Twenty-fourth and Twenty-fifth street! The complaint alleges that the tax levy for the opening of the avenue was made without authority of law in that due notice of intention was not given at the time the main lei was made and again wherl a supple-mental supple-mental levy was made, I he first i:i PH0 and the latter in 11)12 The plaintiffs claim that they have property abutting the avenue which has been assessed to pay for the opening of the street, the assessment in all amounting (o 92,178.82.
