Show Witness In Sugar Case Denies That Company Used Coercion Denver, Aug. 15. That L. L. Alt-ken Alt-ken had told him that In the event that Darley did not succeed In raising cash for his projected sugar factory at Durango, Colo., Darley would have to como to the Interests Aitken represented, rep-resented, meaning as Mr. Tulley took It, the "sugar trust;" that Aitken was In cIoeo relations with Charles Roet-tscher Roet-tscher of the Great Western Sugar company and that Aitken had telephoned tele-phoned A P Cnmp, of tho First National Na-tional bank of Durango, telling hlra to head off tho Darley project be-causo be-causo the Great Western company desired de-sired that field for Itself was the gist of the testimony given today by the Thomas H. Tulley. When Mr. Tulley fir3t took the stand ho announced that he had decided to answer the questions ho had refused to answer to yesterday on the ground that he could find no attorney who would advise him against testifying In a government suit Counsel for the Great Western company finally objected to Teuuely's testimony, but stated that the defense did so without advising the witness. Tulley further testified that Aitken had told him that the Boettscher had planned three factories for the Durango Dur-ango district and that there would be no trouble In Durango's getting a factory once the Darley propject wa,"j out of the way. J. L. MacNeil. vice president of tha First National bank of Durango, was called to present t certified copy of a report made by him and others to the Durango chamber of commerce against the Darley projecL McNeil testified that Mr. Boet-tscher Boet-tscher was a director and stockholder stockhold-er In tho Durango bank. Tho first witness for the defense was L. L. Aitken. He admitted having hav-ing conferences with Mr. Boettschor, but said they were purely to Interest Mr. Boettscher in the general development devel-opment of the Durango district and that no reference was made In any conference to the Darley projecL N. Aitken denied having called up tho Durango bank peoplo and instructing instruct-ing them to put a damper on far Darley project. He also denied making mak-ing the statements that Mr. Tulley attributed to him. |
