Show CONVERSE IS COMING FOR SENTENCE This morning Judge J. E. Bagley received re-ceived a telegram stating that C H Converse would arrive In Ogdcn tomorrow to-morrow preparatory to his appearance in the district court Friday, to rccelvo Hcntcncc for grand larceny, of which he was found guilty by a Jury In Judge Ilwell's court In 1910. The court a few days ago ordered tho sheriff to summon Mr. Converse Into court to receive sentence or on his failuro to appear, the bond for $500 to be declared forfeited. Since that time it haB beon thought that Mr. Converse would not appear and that the bond would be forfeited. Judco Bagley had not heard from his client for a number of months and had no idea where he was until the telegram of this morning came About two months ago Mr Bagley learned that Converse was In San FrauclBCO, at the bedside of his wife who was 111. but no word had been received from him since that timo It was a surprise to Mr Baglev to receive the telegram giving the Information that Mr. Converse would appear in court for sentence There is only $500 Involved In-volved and Mr. Converse's son-ln-lnw. wno rurnished security to the bondsmen, bonds-men, is comparatively well-to-do, and, tho attorney thought, the family would not submit to Converse's Imprisonment Imprison-ment for one year for that amount of money. It seems, however, that Con-1 Con-1 verso prqfers to serve the timo If It becomos necessary and therefore hastens hast-ens from California at the command of tho court. It will be recalled that Converse was found guilty of stealing about $100 worth of hat plumes and was sentenced sen-tenced to Berve one year in the state penitentiary The caso was appealed to tho supreme court, tho Judgment of the lower court affirmed and execution exe-cution of sentence ordered, the result re-sult being that tho sheriff was instructed in-structed to bring the prisoner into court for ro-sentence. Judge Bagley mates that he firmly believes In tho Innocenco of Mr Converse Con-verse and that ho shall take steps to stay the execution of the sentence, either by a suspended sentence or the intenention of exocutive clemency clem-ency In the shnpo of a pardon. It 13 within the power of the district court to suspend sentence and it Is also within the prerogative of the governor of the state to extend clemency. |
