First intimation in-timation that the San Diego & Arizona Ari-zona railway, under construction from San Diego, Cal., to Yuma, Ariz., was projected by the Harrlman system, and not by tho Spreckels brothers. Its ostensible builders, who have been popularly connectod with the Santa Fe railway In the proposal, was given to the public today with publication publi-cation of the Southern Pacific company's com-pany's intention of beginning suit for the recovery or s 52,867,000 advanced for tho building of the road. Basis for' tho suit hinges on the interpretation of the contract entered Into between the Southern Pacific and John D. and A. B Spreckels, tho defendants de-fendants assorting that the contract was an option to purchase tho stock of the projected railway while the Southern Pacific claims that it was an agreement to purchase. A statement given out last night by W. I. Broheck, attorney for the Spreckels brothers, said: "Undor the terms of the original contract, wb'lch was made when tho Spreckels brothers saw that tho construction con-struction of) tho road was not Delnu pushed, tho Spreckels wore privileged to bo relieved from the necessity of managing th'e construction of the road upon sixty Hays' notice and delivering deliver-ing the stocjc to tho Southorn Pacific.
