Show OPINIONS M THE SMEI COURT Three opinions, ono rovorelng and two affirming tho Judgment of tho district dis-trict court, were handed down by the supreme court yesterday afternoon. In tho case of A. P. Rasmussen, administrator ad-ministrator of the estate of Hans C. H. Ramlose against' tho Sevier Valley Val-ley Canal company, brought to recover damages for tho alleged unauthorized transfer of stock, tho Judgment of thu district court of Sevier county was roversed and tho caso remanded for a new trial It was alleged that the name, "Hans C H." hnd been changod to "Holgar W." thus making a transfer trans-fer of tho stock belonging to tho decedent de-cedent to Holgar W. Ramlose Tho defendant and appellant in tbo action demurred to tho complaint, but it was overruled by the court, which later sustalnod a domurrof of the plaintiff and respondent to defenses presented by the company Thus the company was not permitted to prove the facts of its defenses. In this tho supreme court says tbo lower court erred and tho case Is reversed. Tho supreme court affirmed tho Judgment of tho district court in the case of Nathaniel Montgomery against Richard T Berrqtt. The action was brought In equity to require Berrett to perform an alleged parol contract under an alleged contract to engage certain irrigation water used on their lands. The action was dismissed owing ow-ing to the fact that the proofs In tho case were not clear, and there was nothing to show that such a contract existed. In the case of Jens , S. Hansen against Michael Mauss and the Mlller-Cahoon Mlller-Cahoon company, the judgment of tho district court, also, was affirmed. This caso was begun in tho city court and a judgment was secured against Mauss. Later a Judgment was secured against the defendants in tho district court, for $225.58 Tho defendants appealed. |
