Show fence iu counties where a fence is required re-quired by law, the party aggrieved may recover damago and no animals tres-passing tres-passing Bhall be exempt from execution; the owner or occupant of real properly has power to detain animals trespassing until they can be delivered to the constable, con-stable, who shall notify the owners of the amount of damages, and if not paid within two days suit shall be commenced; com-menced; ulantiit shall assess damage; defeudaut may tender any sum and if plaintiff does not obtain judgment for a greater amount than tendered plaintiff plain-tiff pays costs; the net proceeds of sales on execntions shall be paid into the county treasury within six months to the benefit of the school fund provided, pro-vided, if the plaintiff established his right to them they shall be paid plaintiff; the magistrate shall report his proceedings to the county court; the constable is poundkeeper for his precinct; any person per-son interfering with the constable is guilty or a misdemeanor; the provisions provis-ions of the act shall iu no way interfere with existing legal rights of incorporated incorpora-ted cities or towns in relation to animals ani-mals running at large. The New Estray Law.
