Show Rules Are Given For Election of Grazing District .Advisors Frank D. The material is contained in circular No. 1 of the division of grazing and consists of rules providing pro-viding for special elections for district advisors to assist in management man-agement of grazing districts. The matter is as follows: After the establishment of a grazing idiatrict, the director of grazing will perform all functions relating to grazing necessary to carry out the terms of the act of June 28, 1934 (48 Stat. 1269), and such other duties as the secretary of the interior may prescribe. To assist the director of grazing in the performance of his duties, there are authorized to be advisors of local stockmen in each district. To provide for the election of district advisors pending the holding hold-ing of regular annual elections within grazing districts, the following fol-lowing temporary rules will govern: A special election of, district ad- visors shall be held in each grazing graz-ing district within 90 days after the promulgation of the order therefor. Notice of the time and place of said election shall be published in some newspaper of general circulation circu-lation in the locality by the register regis-ter of the U. S. Land offiice for the area or areas affected. The notice will also be posted in that office and in the principal post office of-fice in the locality involved. Any "person offering to vote at such election shall possess the following fol-lowing qualifirations: I. U. S. citizenship or one who has filed his declaration of intention inten-tion to become a citizen. II. A group, association or corporation cor-poration authorized to conduct business under the laws of the state in which the grazing district is located. Each such group, association, as-sociation, or corporation shall have one vote regardless of the number of members, partners, or stockholders. Such vote shall be cast, by any authorized member, agent or officer. (Continued from page 5) Rules For Election Under Grazing Act 'Cori' i-.i;e'! f..n first page.) III. A voter must have the qualifications quali-fications of a permittee in the district dis-trict where he votes, which means that he must come under one of the following classes: 1. A bona fide settler or, occupant oc-cupant of land in or near the district, dis-trict, owning livestock; j 2. A resident within or near the district owning livestock; 3. A stock owner who has customarily cus-tomarily run livestock on the public pub-lic range of the district; 4. A land owner or lessee in or near the district engaged in the livestock business or an owner or lessee of water or water rights, tho proper use of whose land or water requires grazing privileges within the district. The ballot boxes shall be kept open on the day of the election from 2:00 p.m. to 5:00 p.m. and as j much longer as necessary to allow j those present at 5:00 p.m. to vote who have riot voted. The director of grazing may ! divide the district into voting pre-' pre-' cincts and fix the boundaries thereof and allocate number and classes of advisors to be elected therefrom and may designate voting places within such precincts convenient to the voters. The representative of the divi-I divi-I sion of grazing present at the time specified for opening the meeting shall with the consent of the elec-j elec-j tors present choose three electors j to act as election judges, and the electors present may place in , nomination the names of candi-! candi-! dates, but voting shall not be re-i re-i stricted to any nominee. j Each voter shall prepare his own ballot by writing upon a piece of ' paper the name of the candidate or candidates for whom he votes. Each voter shall before depositing his ballot, state his name anr residence resi-dence to the election judges and be registered by them, j Any person offering to vote may ! be challenged by any qualified I elector of the district, and thereupon there-upon the judges of election or one of them may require him to answer such questions, concerning his qualifications as a voter, as they may see fit. If the person so challenged shall refuse or fail satisfactorily to show to the judge his voting qualifications, quali-fications, his vote shall be rejected; reject-ed; and the judges may after challenge reject .the vote of any person offering to vote if in their judgment the said voter is not qualified to vote. Each candidate at any election shall have the right to appoint any qualified elector to remain within the polling places during the casting cast-ing and counting of votes and the declaration of the results thereof, anil such person may act as a challenger. chal-lenger. Each elector shall vote once in only one district or precinct and for the candidate or candidates for the class of owners of livestock to which he belongs; and if he belongs be-longs to more than one such group, he shall elect with which class he will vote. Where districts are divided into voting precincts, voters shall vote only for the candidates from their precinct. Owners of not to exceed ten head of livestock kept for domes-i domes-i tic purposes will be entitled to j have one district advisor and j such representative shall be a : member of the class owners who own not to exceed ten head of livestock live-stock kept for domestic purposes and who are otherwise eligible for a free use grazing permit. Persons eligible only for free use grazing permits shall be permitted per-mitted to vote only for one of the nominees from their class and will not be permitted to vote for any other member. Voting must be done personally, and proxies will not be recognized nor accepted. Immediately after the closing of the polls, the judges shall open the ballot box and count the votes. In case of a tie vote, a choice by lot shall thereupon be made by the judges in the presence of the tie candidates, or at least one representative repre-sentative approved by each candidate candi-date for such purpose. I As soon as the ballots shall have been counted, the judges shall i make out a certificate of returns j under their hands, stating the number of votes cast, the number ; of excess, unused, or spoiled ballots, bal-lots, and the number of votes re-; re-; ceived by each candidate, both in 1 words and numerical figures. ! The judges of election shall post I one copy of the notice of the re- 'suit of the election at the polling! place. ' The registration list of voters,; toretn?r with the ballots, shall be enclosed and sealed and forthwith delivered to the representative of the division of grazing, together with a notice of the result of the election signed by the judges. DISTRICT ADVISORS Qualification All district advisors must possess pos-sess the qualifications of an elector elec-tor as set forth in paragraphs 1, 2, 3, and any other provisions of this circular; and at least half of such advisors in each livestock section shall be persons who have had experiences ex-periences with livestock on the public lands of the district prior to January 1, 1934. The member representing the free use permittees permit-tees shall not be required to have previous range experience. Members selected at such election, elec-tion, if thereafter regularly appointed, ap-pointed, shall be required to qualify quali-fy by an oath of office. Term of Office Persons thus selected for the first district advisors of a grazing district may be appointed by the secretary of the interior to hold office only until the regular annual an-nual election within the district. The secretary reserves the right to refuse appointment of any one for the good of the service. Titlo The candidates, when duly elected elect-ed and appointed, shall be known as district advisors. Pay District advisors shall when called for service by the director of grazing, and not otherwise, receive re-ceive the sum of $5.00 a day out of such funds as may hereafter be made available for that purpose, for each day necessrily spent in the performance of their duties; and in addition thereto, their necessary actual travel expense, as defined in the regulations, from their home to the place of performance per-formance of such duty. Meetings District advisors shall meet as soon as practicable after their election and elect a chairman for the section representing each class of livestock and also a general chairman. Meeting of the district advisors shall be open to the public except that the advisors may meet in executive ex-ecutive session in considering recommendations for the granting of permits or for any other matter where such action is deemed advisable ad-visable and the representative of division of grazing concurs. Duties District advisors shall recommend recom-mend the issuance of grazing licenses and such special rules for range practice as seen advisable. The district advisors may serve as members of a committee to represent rep-resent and transact business in furtherance of the interests of the licensees of the district, not in conflict with the Taylor grazing act or the rules and regulations thereunder, when properly authorized author-ized to do so by vote of the said licensees, provided that the performance per-formance of such services shall be independent of fheir duties as an advisory committee and they shall not receive any compensation or salary therefor from the United States. Removal of Members The secretary of the interior reserves re-serves the right to remove any district advisor for failure to discharge dis-charge the prescribed duties of . his office in accordance with the laws and regulations or for tho good of tho service. Filling of Vacancies A vacancy in the position of district dis-trict advisor occurring either by resignation, removal or otherwise, shall be filled by appointment by the secretary of the interior and the appointee shall hold office until the next regular election when a successor shall be elected.
