Constitutional Amendment No. 2 A Joint Resolution Proposing an Amendment Amend-ment to Section 10, of Article VII. of the i Constitution Relating to Governor's Ap-i Ap-i pointive Power and the Filling of Vacancies Va-cancies tn Certain Offices. (Superintendent (Superin-tendent of Public Instruction.) Be it resolved by the Legislature of the State of Utah, two-thirds of all the members elected to each houaa concurring concur-ring therein : SECTION 1. That it is proposed to amend Section 10, of Article VII, of the Constitution of the State ot Utah, as follows fol-lows : SECTION 10. The Governor shall nominate, nom-inate, and by and with the consent of the Senate, appoint all State and district officers offi-cers whose offices are established by this Constitution, or which may be created by law, and whose appointment or election la not otherwise provided for. If, during the recess of the Senate, a vacancy occur in any State or district office, the Governor hall appoint some fit person to discharge the duties thereof until the next meeting of the Senate, when he shall nominate some person to fill such office. If the office of justice of the supreme or district court. Secretary of State, State Auditor, State Treasurer, or Attorney-General be vacated by death, resignation or otherwise, it shall be the duty of the Governor to fill the same by appointment, and the appointee shall hold his office until his successor shall be lected and qualified, as may be by law provided. SECTION 2. The Secretary of State is hereby directed to Bubmit this proposed amendment to the elector of the state at the next general election in the manner provided by law. SECTION 3. That it is proposed to, amend Section 8, of Article X, of the Con-! titution of the State of Utah, as follows: SECTION 8. The general control and upervision of the Public School System hall be vested in a State Board of Education, Educa-tion, consisting: of such persons as the Legislature may provide. SECTION 2. Be it resolved by the Legislature .of the State of Utah, two-thirds of all the members mem-bers elected to each of the two house voting in favor thereof : SECTION 1. That it is proposed to amend Section 18, Article XII. of the Constitution Con-stitution of the State of Utah, so that the same will read as follows: SECTION 18. Exemptions, and lh Annual Tax for the State. Be it resolved by the Legislature o! thi State of Utah, two-third of all munberi j elected to ach House and two-thirds ol all members of each House concurring therein: I SECTION 1. That it is proposed tc amend Article XIII. Section l of the Con- titution of the State of Utah, as amended at the Keneral election in 1930, to read as ( follows : SECTION 2. All tangible property in the State, not exempt under the laws of the United States, or under this constitution, shall be taxed in proportion to its vnlue. to be ascertained as provided by law. Th property of the United States, of the State, counties, cities, towns, school districts, municipal mu-nicipal corporations end public libranea, lota with the buildings thereon used exclusively exclu-sively for either religious worship or charitable char-itable purposes, and places of burial not held or used for private or corporate benefit, bene-fit, shall be exempt from taxation. Water rights, ditches, canals, reservoirs, power plants, pumping plants, transmission lines, pipes and flumes owned and ustd by individuals indi-viduals or corporations for irrigating lands within the state owned by such individuals or corporations, or the individual members thereof, shall not be separately taxed as long as they shall be owned and used exclusively ex-clusively for surh purposes. Power plants, power transmission lines and other property proper-ty used foi generating and deliverinn electrical elec-trical power, a portion of which is used for furnishing power for pumping water for irrigation purpose on lands in the State of Utah, may be exempted from taxation taxa-tion to the extent that such property is used for such purposes. These exemptions shall accrue to the benefit of the users of water so pumped under such regulations a the legislature may prescribe. The taxes of the indigent poor may be remitted or abated at such times and in such maner as may be provided by law. The legislature may provide for the exemption from taxation taxa-tion of homes, homesteads, and personal property, not to exceed $2,000 in value for homes and. homesteads, and $300 for personal per-sonal property. Property not to exceed $3,000 in value, owned by disablr persons who served in any war in the military service serv-ice of the United States or of the Stat of Utah and by the unmarried widows and minor orphans of such persons may be exempted ex-empted as the legislature may provide. The legislature shall provide by law for an annual tax sufficient, witfi other sources of revenue, to defray the estimated ordinary ordin-ary expenses ot the state for each fiscal year. For trfe purpose of paying the stat debt. If any there be, trie legislature shall provide for levying a tax annually, sufficient suffi-cient to pay the annual interest and to pay the principal of such debt, within twenty years from the final passage of the law creating the debt. (As amended November Novem-ber 4, 1930.) SECTION 2. Thnt it is proposed to amend Section 9. Article VI, of the Constitution Con-stitution of the State of Utah, as follows: SECTION 9. The member of the Legislature Legis-lature shall receive such per diem and mileage mile-age as the Legislature may provide, not exceeding ex-ceeding eight dollars per day and ten cents per mile for the distance necessarily traveled trav-eled going to and returning from th place of meeting on the most usual rout, and they shall receive no other pay or par-Quislte. par-Quislte.
