However, reports that the disability claims would be denied consideration 4 by the bureau if not proven prior to June 7, 1027, were without foundation, founda-tion, according to Miller after discussing discuss-ing the matter with the bureau's of ficials In Washington. According to Miller, the erroneous reports must have been based upon a misunderstanding of certain instructions instruc-tions sent out to the Held by the central cen-tral otlice of the bureau, calling at-4 at-4 teutiou to the fact that June 7 was 1 the last date on which evidence show ing service connection would be accepted ac-cepted unless certain requirements ot the governing law were complied with. Miller stated that his otlice which the Legion maintains in Washington and the veterans' bureau are substantially substan-tially in accord with the following outline of the situation relative to the filing and proving up of claims for disability benefits: A claim must be tiled within five years from date of discharge or res-iguatiou res-iguatiou from service; within five years of death which occurred during service; or within five years of the beginning of the 10 per cent or greater great-er disability, the director of the veterans' vet-erans' bureau having authority to grant a further extension of five years in his discretion. Evidence can be presented at any lime in proof of any service incurred or aggravated disability when it can be shown that the disability was 10 per cent or more within one year after discharge or resignation from service. In new claims care should be taken that the filing of prof of disability within one year from discharge from service does not conflict with the gross ten years allowed for claiming. When there is an official record ot the injury or disability during service or at the time of separation from service, serv-ice, the disability is compensable but subject to the time limitations for filing. In tuberculosis and neuropsychiatry cases where presuuitive service connection con-nection is claimed under the terms of section 200 of the World War Veterans' Veter-ans' Act, evidence of the existence of the disease within the presumtive period pe-riod (prior to January 1, 1925) could have been submitted subsequent to June 7, 1927. Only a few cases were affected by the limiting date of June 7. |
