Show Not an Exclusive Court. The New York Independent thinks that petitions pe-titions to the Senate to deny Apostle Smoot a seat . in that body were all wrong, as wrong as would be petitions to the Supreme Court to decide a cause before it in a certain way. Of course, over this the Deseret News rejoices greatly. Nevertheless, the reasoning of the Independent, in the light of the facts that govern, will not bear analysis, because from the first no case can be cited where a Senate committee or the full Senate has ever set on any case exclusively as a legal court. There never was any intention that such should be the case, because if there had been the Constitution would have given to the Senate both exclusive and clearly defined legislative and judicial ju-dicial powers. |
