Show Sixth District Court Actions PANGUITCH - Judge K. L. Mclff and Sixth District Court staff experienced a ful agenda in court Thursday, May 8. Kenneth Thompson, 29, Panguitch, was brought from jail and appeared in court on an order to show cause why his probation should not be revoked. Thompson had been enrolled at Horizon House in a drugalcohol treatment program as part of his probation in a second sec-ond degree felony charge of illegal ille-gal possession or use of a controlled con-trolled substance. He walked away from that facility and later turned himself in to his Parole Officer Reid Bean. Thompson was appointed Public Defender John Hummel, however, as per Thompson's lead, he admitted openly to the allegations and asked to be sent to prison. Thompson was remanded to state custody to serve the original origi-nal 1-15 years at the Draper facility. Rick Burningham, 48, Panguitch, was before the court (See COURT on page 2A) ! Court From Front Page 1 on an initial appearance for a I single count of unlawful acquisi- I tion and possession of a financial finan-cial transaction card, a third degree felony. Burningham made application for indigency to obtain an appointed public defender. His application was denied on the basis of too high of income. Burningham was ordered by the court to retain his own counsel. Garfield County . Attorney Wallace Lee informed - the court of a conflict of interest because he serves as bishop in Burningham,s LDS Ward, creat- , ing an ecclesiastical conflict. Lee was asked by Judge Mclff to hire a deputy prosecutor in his stead. The case was set for a i preliminary hearing on June 5 at . 1 1 a.m. Stacy Wade Chynoweth, 23, Henrieville, was before the court on an order to show cause why ; '. his probation should not be -' revoked. Chynoweth was on probation for a charge of aiding and assisting wanton destruction of protected wildlife (deer). He admitted to allegations of failure to pay fines and restitution and ' failure to complete community service. His probation was continued con-tinued with changes and he was ordered by the court to bring all fines current by May 15 and assigned 20 hours of community service current within 30 days. Donald Corwin, 43, Las Vegas, Nev., was scheduled in court for sentencing. The case was rescheduled for July 10 at 10 a.m. Mark Crandall, 47, Panguitch, was before the court on a status review. He had been sentenced in January to one year in the county jail and was requesting early release. Judge Mclff asked Reid Bean of Adult Probation and Parole to prepare a written recommendation rec-ommendation on Crandall for possible probation and he would use that to make his determination. determina-tion. Michael Wade Houston, 32, Beaver, came before the court of an entry of plea on five separate counts. Houston was charged with possession of controlled substance (methamphetamine) in a drug-free zone (dfz), a second sec-ond degree felony; possession of a conttrolled substance (methamphetamine), a third degree felony; possession of drug paraphernalia in a dfz, a class A misdemeanor; driving under the influence, a class B misdemeanor, and speeding, a class C misdemeanor (handled in justice court). Houston was appointed Public Defender John Hummel and a plea in abeyance was agreed upon. Houston pleaded guilty to the first four counts, was given 18 months supervised probation through Adult Probation and Parole and 30 days incarceration. He was given 20 weekends in which to serve his sentence and pay a fine of $1850. Upon successful completion of probation he can request dismissal of the charges. Dimitrios "James" Constantine Sourvalis, 37, Salt Lake City, a prisoner at Garfield County Correctional Facility because of a parole violation, came before the court on five counts following a traffic in Garfield County in March 2001. He was charged with possession of a controlled substance (heroin) (hero-in) with intent to distribute with two enhancements (prior drug charges and the offense was committed in a drug free zone), a first degree felony; possession of a controlled substance (methamphetamine) with intent in dfz with same enhancements, a first degree felony; poss. or use of con. sub. (marij), third degree felony; poss. of drug paraphernalia in dfz, a class A misdemeanor and driving on suspension or revocation, a class C misdemeanor. (See COURT on page 4A) Sixth District Court From Page 4A Sourvalis was appointed Public Defender John Hummel and waived all rights to post conviction convic-tion remedies. He plead guilty to a single count of aiding and assisting possession of a controlled con-trolled substance (heroin), a third degree felony. He will serve 0-5 years concurrent with his present sentence. Richard Cadmus, 29, Panguitch was before the court on a review of his sentence for possession of a controlled substance sub-stance (methamphetamine), a third degree felony and possession posses-sion of drug paraphernalia, a class A misdemeanor. Cadmus has been ordered to serve 28 days incarceration and had asked for an extension of time in which to do so and was granted permission by Judge David Mower. He was now requesting to serve the remainder of his time on weekends and was granted permission to do so. Larry Shawn Moreland, 22, Santaquin, was to appear to answer to an order to show cause why his probation should not be revoked for failure to pay fines. Paper work was unable to be served on Moreland due to a change of address and no forwarding for-warding address on record. A bench warrant for $1850 was issued by the court. Stacy Lyman, 48, Bicknell, was before the court on an initial appearance. Lyman had seven charges including one count of possession of a controlled substance sub-stance (marijuana) with intent to distribute in a drug free zone, a second degree felony; driving under the influence, a third degree felony; unlawful possession posses-sion of a dangerous weapon, a third degree felony; possession ' of drug paraphernalia in dfz, a class A misdemeanor; threats to interfere with official or political politi-cal action, a class A misdemeanor; misde-meanor; open container, class C misdemeanor and disorderly conduct, an infraction. Public Defender John Hummel was appointed as counsel and a preliminary pre-liminary hearing was set for June 26 at 11 a.m. |
