Barnes noted that the PSI categorizes Hatch as a "player" in the drug community but that the court should note that these were not large quantities that were bought and sold in the arrests. Barnes also asked the court to consider that the co-defendant in this case, who was present during the offenses, was given a class A misdemeanor and 24-months probation. proba-tion. Barnes respectfully asked the court to allow a 70-day diagnostic to take place to allow another party to look at Hatch and return to court after that. Judge Mower stated on the record that he believed the recommendation recom-mendation by the state for prison was because Hatch had been dealing drugs a long time and had just not been caught. Judge Mower asked the defendant if he would like to say anything in his own behalf. Hatch said he believed the recommendation recommen-dation by the state for prison was too much, that he had been dealing drugs but not for years and years, mostly the last couple of years. The judge advised all parties concerned that he thought there may be some advantage to a diagnostic evaluation. He said his decision was a close call but he felt close calls should go to the defendant. He committed Hatch to the custody of the sheriff for transport to the Utah State Prison to undergo diagnostic diag-nostic evaluation. Judge Mower stated further that the one thing he picked up on in the pre-sentence report was a big discrepancy between the level of drug activity the state is claiming and what Hatch admits. Mower said he believes Hatch may be "minimizing" his role but that the diagnostic should answer that. He set the date of Feb. 20, 1997 for Hatch to return for sentencing. |
