Show DING RESOLUTION NO. 1982-1, RULES OF OPERATION OPERA-TION OF THE PAN-GUITCH PAN-GUITCH CITY CORPORATION CORPORA-TION SECONDARY WATER WA-TER SYSTEM, AS AMENDED. AMEN-DED. PROVIDING FOR CHANGES TO MONTHLY RESIDENTIAL AND COM-MERICAL COM-MERICAL CULINARY CONNECTION CHARGES. WHEREAS, Section 14-117, Code of Revised Ordinances of the City of Panguitch, provides that the rates and other charges incidental inciden-tal to connection and services from the municipal water system shall be fixed from time to time by resolution reso-lution enacted by the governing body: and WHEREAS, On or about August 17, 1982, Panguitch City passed Resolution No. 1982-1, Rules of Operation of the Panguitch Pan-guitch City Corporation Secondary Water System; and WHEREAS. Article V of Resolution No. 1982-1 sets forth the monthly service charge amounts am-ounts for residential and commercial com-mercial water users; and WHEREAS, On or about January 22, 1991, the Panguitch City Council amended Resolution 1982-1, Article V, Section 13, to raise the base water rate for residential resid-ential and commercial culinary water wa-ter service within the City of Panguitch: Pan-guitch: and WHEREAS. The Mayor and City Council of Panguitch City now deem it necessary to further amend Resolution No. 1982-1, as amended to increase the allowable base usage amount of culinary water wa-ter per month, as set forth in Article Arti-cle v, Section 13 of said Resolution. Resolu-tion. NOW THEREFORE BE IT RESOLVED BY THE MAY- 8R AND CITY COUNCIL F PANGUITCH CITY, GARFIELD COUNTY! STATE OF UTAH, AS FOLLOWS: l. Resolution 1982-1, Article Arti-cle V, Section 13, shall be amended to read as follows: 13. SERVICE CHARGE AMOUNTS: bach connection which has been installed in the city water system shall be charged a monthly service charge. The minimum mini-mum monthly charge shall be paid by all connections. The monthly service charge for each type of connection con-nection shall be as follows: CHARGES- A monthly service charge ot $ 14.00 per connection shall be charged on a base usage amount of 15,000 gallons of water per month, for all residential culinary culi-nary system connections within the corporate limits of Panguitch City. Any monthly water usage above the base usage amount established above shall be filled and added to the consumer's monthly bill at a rate of .60 cents per one thousand (1,000) gallons used, as shown by periodic readings of each residential residen-tial consumer's water meter, at the discretion of the Panguitch City Council. b. MONTHLY RESIDENTIAL, RESI-DENTIAL, SJKUOflUAgV CHARGES; A monthly service charge ot 54.00 per connection shalrbe charged for all residential secondary system connections within tne corporate limits of Panguitch City. MERCICALMQOTfrTN RY CHARGES- A monthly service charge of $14.00 per connection shall be charged on a base usage amount of 15,000 gallons of water per month, for all commercial culinary system connections within the corporate limits of Panguitch City. Any monthly water wa-ter usage above the base usage amount established above shall be billed and added to the consumer's monthly bill at a rate of .60 cents per one thousand (1,000) gallons used, as shown by periodic readings of each commercial consumer's water wa-ter meter, at the discretion of the Panguitch City Council, term "residential connection" for purpose of the secondary system shall be deemed to apply to any residence res-idence on a lot within the incorporated incorpor-ated area of the Panguitch City limits, up to a maximum of 1 15 12 feet by 231 feet in size. u e. COMMERCIAL LOTS: All commercial lots, which are used exclusively for commercial purposes, and on which at least 75 of the property area is comprised of buildings and automobile auto-mobile parking area, will be exempt ex-empt from paying any monthly or annual secondary system service charges for water use. SPECIAL CONSIDERATION: CONSID-ERATION: In the event any water user has property which deserves special consideration, regarding monthly or annual service charges for water use, the City Council reserves re-serves the right to consider the same, pursuant to the provisions of Section 14 of this Resolution. h. In addition. Five Hundred ($500.00) dollars per month shall be added to a reserve and emergency repair and replacement fund for the first six years of the bond repayment repay-ment schedule, until a total of Thirty-Five Thousand ($35,000.00) dollars is accumulated. 2. CON-VICTIONS. WHEREAS, Part 1-331 and 1-332, 1-332, Code of Revised Ordinances of the City of Panguitch provide for fines to be imposed on persons and corporations convicted of a misdemeanor misde-meanor or infraction; and WHEREAS. Since adoption of Parts 1-331 and 1-332, the amount of fine which may be imposed upon conviction of a misdemeanor or infraction in-fraction has been increased pursuant pursu-ant to 76-3-301 and 76-3-302; Utah Code Annotated (1953, as amended and WHEREAS. The Mayor and City Council of Panguitch City desire de-sire to increase the maximum fine which may be imposed upon conviction con-viction of misdemeanors and infractions in-fractions to that allowed by Utah State Law. NOW THEREFORE BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF PANGUITCH CITY, GARFIELD COUNTY. STATE dF UTAH, AS FOLLOWS: 1. Part 1-331, Code of Revised Ordinances of the City of Panguitch Pan-guitch shall be amended to read as Follows: 1-331. FINES OF PERSONS. PER-SONS. A person who has been convicted con-victed of an offense may, in addition addi-tion to any term of imprisonment imposed, be sentenced to pay a fine not exceeding: (a) , $1,000.00 when the conviction is of a class B misdemeanor, misde-meanor, and (b) , $500.00 when the conviction is of a class C misdemeanor misde-meanor or infraction. 2. Part 1-322. Code of Revised Ordinances of the City of Panguitch Pan-guitch shall be amendea to read as follows: 1-332. FINES OF CORPORATIONS. COR-PORATIONS. ASSOCIATIONS, PARTNERSHIPS, OR GOVERNMENTAL GOV-ERNMENTAL INSTRUMENTALITIES, INSTRUMEN-TALITIES, The sentence to pay a fine, when imposed upon a corporation, corpora-tion, association, partnership, or governmental instrumentality for an offense defined in this code or the ordinances of the municipality or for any offense defined outside of this code over which this municipality muni-cipality has jurisdiction, for which no special corporate fine is specified, speci-fied, shall be sentenced to pay an amount fixed by the court, not exceeding: ex-ceeding: . (a) $5,000.00 when the conviction is for a class B misdemeanor, misdem-eanor, and - . (b) $1,000.00 when the conviction is for a class C misdemeanor misdem-eanor or for an infraction. (3) In the opinion of the Mayor and City Council of Panguitch City, it is necessary to the preservation preser-vation of the health, safety and welfare of the residents of Panguitch Pan-guitch City, that this Ordinance take effect immediately. WA-TER. FORMALLY ADOPTING RULES AND REGULATIONS LIMITING USE OF CULINARY AND SECONDARY WATER, AND SETTING POLICY CONCERNING CON-CERNING CRIMINAL PROSECUTION PROSE-CUTION FOR VIOLATION OF SAID REGULATION. WHEREAS. Part 14-134, Code of Revised Ordinances of the City of Panguitch, as amended, provides authority for the Mayor and City Council to enact rules and regulations regula-tions limiting the use of water as necessary in their discretion to preserve pre-serve the water supplies of the City of Panguitch in times of scarcity of water, and also make it a Class B Misdemeanor for any person per-son to violate any such rules or regulations made pursuant to the provisions of said ordinance. WHEREAS, A situation currently cur-rently exists in which there is a scarcity of water in the culinary and secondary water systems of the City of Panguitch, and the Mayor ana City Council deem it necessary, pursuant to the authority granted in said Part 14-134, to enact rules and regulations governing the use of water from the Panguitch City culinary and secondary water systems. NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF PANGUITCH CITY, GARFIELD COUNTY. STATE OF UTAH, AS FOLLOWS: 1. The Mayor and City Council of Panguitch City hereby declare that there currently exists a water emergency in the City of Panguitch, Pan-guitch, due to scarcity of water. 2. Pursuant to the authority granted the Mayor and City Council Coun-cil in Part 14-134 Code of Revised Ordinances of the City of Panguitch, Pan-guitch, as amended, the following rules and regulations limiting the use of culinary and secondary water from the Panguitch City water system are nereby formally adopted: (a) Sprinkling devices shall be required to be used at all times for outside watering from either the culinary or secondary systems. There shall be no open hose watering. (b) The culinary water system may be used for outside wa-teringonly wa-teringonly from 6:00 a.m. to 11:00 a.m.fTuesday through Sunday. No use of the culinary water system shall be allowed for outside water.-ing water.-ing on Monday. , (c) The City of Panguitch shall be divided into four (4) sections sec-tions for purposed of limiting the use of secondary system water. Each section shall water from the secondary system only every fourth day, according to the schedule sched-ule attached hereto and incorporated incorporat-ed herein by this reference as Exhibit Ex-hibit "A." 7 (d) All of the requirements require-ments and provisions previously adopted ana set forth in Chapter 14-100, Code of Revised Ordinances Ordinan-ces of he City of Panguitch are hereby incorporated by This reference, refer-ence, as necessary to effectuate the Proper conservation of water in the anguitch City culinary and secondary secon-dary water systems. 3. The rules and regulation adopted herein shall remain in full force and effect until such time as the Mayor and City Council determine de-termine that the water emergency due to scarcity is abated, and such rules are no longer necessary to & reserve the supplies of water in le culinary and secondary systems. Such other and further rules and regulations as the Mayor and City Council, in their discretion, shall deem necessary may be added at any time, by proclamation or resolution resolu-tion during the course of the water emergency herein declared, pursuant pursu-ant to Part 14-134. 4. The following policy is adopted concerning criminal prosecution prose-cution pursuant to Part 14-134, Code of Revised Ordinances of the City of Panguitch: (a) The Panguitch City Police Department is hereby charged with the primary responsibility responsi-bility for monitoring water use pursuant to the regulations adopted herein, and for issuing such warnings and citations as are required re-quired herein and by Part 14-134. (b) Upon the first violation viola-tion of any rule or regulation herein adopted, the violator shall receive a verbal and written warning warn-ing of the violation, and shall be ordered to cease and desist from any further violations. (c) On the second and subsequent sub-sequent violation, the matter shall be referred for prosecution as a Class B Misdemeanor, pursuant to Part 14-134,, either by citation or by information and summons or warrant. 2.
