NOTICE OF INTENTION TO ESTABLISH PANGUITCH PAVILION OF NATIVE HISTORY SPECIAL SERVICE DISTRICT NOTICE IS HEREBY GIVEN that on November 5. 1991, the Mayor and City Council of Panguitch City, County of Garfield, State of Utah, adopted a Resolution declaring that the public health, convenience and necessity require the establishment of a special spe-cial service district to be called "Panguitch Pavilion of Native History His-tory Special Service District" (the "District"), for the purpose of recreation recre-ation services within the boundaries of the District. The Resolution also provides for a public hearing to be field at the Panguitch City Council Chambers in the Garfield County Courthouse at 55 South Main Street, Panguitch, Utah, at 7:00 p.m. on the 5th day of December, De-cember, 1991. DESCRIPTION OF THE PROPOSED DISTRICT The District shall have the following fol-lowing boundaries: The West 222.0 feet of the North 156.0 feet of Lot 1, Block 37, Plat "B", Panguitch Town Survey Sur-vey and the East 39.0 feet of the North 156 feet of Lot 2, Block 37, Plat "B", Panguitch Town Survey. PROPOSED SERVICES The District will be authorized to obtain and administer funds from grants loans, and donations to maintain and operate the Panguitch Pavilion of Native History, to be located within the District, together with acquisition of necessary tacili-ties, tacili-ties, appurtenances, and equipment therefor. Also together with acquisition acqui-sition of necessary facilities, appurtenances appur-tenances and equipment for transportation trans-portation services connected with said Panguitch Pavilion of Native History. METHOD OF FINANCING Pursuant to the provisions of the Utah Special Service District Act. Section 17A-2-1301, Utah Code Annotated, (1953 as amended), and Article XI V Section 8 of the Constitution of Utah, the District may annually impose fees and charges to pay for all or a part of the services to be provided by the District. It may also annually levy taxes upon all taxable property within the District to provide the proposed services, ana may issue bonds for the acquisition andor construction of facilities or systems to provide said services; provided, however, that said levy to provide said services or to repay said bonds, must be authorized ana approved by a majority of the qualified electors of the District at an election for that purpose. PUBLIC HEARING ON PROPOSED ESTABLISHMENT OF " SPECIAL SERVICE DISTRICT At the public hearing at the time and place set forth herein, any interested inter-ested person may protest the establishment estab-lishment of the District or the furnishing fur-nishing of specified types of services, servi-ces, within a service district, either orally at the hearing or in writing at the hearing or at any time prior to the hearing, or within fifteen (15) days after the conclusion of the hearing. Written protests must be filed with the City Recorder, and may be withdrawn by filing a withdrawal with-drawal of protest within thirty (30) days after the hearing. Any protest signed on behalf of a corporation owning property in the District shall be sufficient if it is signed by the president, vice president, or any duly authorized agent of the corporation. Where title ti-tle to any property is held in the name of more than one person, all of the persons holding title to the property must join in the signing of tne protest. At said public hearing, the Mayor and City Council will give , full consideration to all protests which shall have been filed and will hear and consider all interested persons per-sons desiring to be heard. The Mayor and City Council may continue con-tinue the hearing from time to time. After conclusion of the hearing, hear-ing, the Mayor and City Council shall adopt a resolution either establishing estab-lishing the Panguitch Pavilion of Native History Service District, or determine that the establishment of the District shall be abandoned; or may in its discretion, reduce the boundaries of the District and establish estab-lish the District by resolution, as modified. The boundaries may not be increased or additional types of services added unless a new public hearing is held. If, within fifteen (15) days after the conclusion of the hearing, over fifty percent (50) of the qualified voters of the territory proposed to be included within tne District, or the owners of over fifty percent (50) of the taxable value of the taxable property included within the proposed District file written protest against the establishment of the proposed District or against the specified type of service to be provided pro-vided within the District with the City Recorder, the Council is required re-quired by law, in the former instance, in-stance, to abandon the proposed establishment of the District; and, in the latter instance, to eliminate the type of service objected to from the resolution finally establishing the District. The Mayor and City Council may consider the voter registration records of Garfield County, State of Utah, as conclusive evidence of residency res-idency in the proposed service District. Dis-trict. Any qualified voter residing within the District who filed a written writ-ten protest, may, within thirty (30) days after the adoption of the'Reso-lution the'Reso-lution establishing the District, apply ap-ply to the District Court of tne Sixth Judicial District for a Writ of Review of the Actions of the Mayor and City Council in establishing estab-lishing the District upon the grounds that such person's property will not be benefitted by the services ser-vices authorized to be furnished by the District, or that the proceedings taken in the establishment of tne District have not been in compliance compli-ance with law. A FAILURE TO APPLY FOR SUCH WRIT OF REVIEW WITHIN WITH-IN THE PRESCRIBED TIME SHALL BAR ANY FURTHER OBJECTION TO THE DISTRICT.
