Show NOTICE OF BORROW SALE UNITED STATES DEPARTMENT OF THE INTERIOR, BUREAU ,OF LAND MANAGEMENT, Utah State Office, University Club Building, 136 East South Temple, Salt Lake City, Utah 84111. Notice is hereby given in accordance with the Materials Act of July 31, 1947 (30 U.S.C. Sees. 601, 602), as amended, and the regulations in 43 CFR Part 3610, at 2:00 p.m., MST, on January 4, 1980, at the above listed address, 480,000 cubic yards of borrow material in Garfield County, Utah, will be offered in a single competitive sale by SEALED BIDS followed by ORAL AUCTION to the qualified high bidder. The minimum appraised sale price is 9c per cubic yard or $43,200 for the entire 480,000 cubic yards. The 480,000 cubic yards of borrow may be paid for in advance or may be paid for in installments equal to the total cost of 96,000 cubic yards of borrow at the unit price bid. The first installment considered as the ad-vance bid deposit, in cash, cashier's check, certified check, bank draft or money order, made payable to the Bureau of Land Management, will accompany the bid. If the high bid is greater than the minimum price, the difference in the bid deposit and 20 percent of the high bid will be paid at the close of oral bidding. The second installment, and the cost of publication of the notice, shall be paid prior to commencement of removal operations. Each additional installment shall become due and payable without prior notice to the pruchaser whenever the value 'of materials extracted shall equal the sum of the second and subsequent installments already paid by the purchaser. The first installment shall be retained as security for the full and faithful performance of the contract as required by Sec. 3 (b) of the terms of the contract, and shall be applied in whole or in part to the payment of the last installment, required hereunder to make the total payment equal the total purchase price. The total amount of purchase price must be paid pnor to 60 days before expiration of the contract. Maximum time for the contract to be completed is 2 years from date of contract, or when the 480,000 cubic yards are removed if that be sooner. Sealed bids must be received prior to 5:00 p.m., MST, on January 3, 1980, at the above listed address. The bids will be opened and read before oral bidding is commenced. The envelope used by a sealed bidder must be plainly marked that it is not to be opened before the date and hour of the bid opening and must show that the bid is for borrow sale U-44547. Bids may not be modified or withdrawn unless the modifications or withdrawals are received on or before 5:00 p.m., MST, on January 3, 1980, at the BLM, Utah State Office. The high bid, if oral, will be confirmed in writing immediately upon con-f elusion of the bidding. A performance bond of $8,700 or 20 percent of the total contract price, whichever is greater, in the form of an acceptable corporate surety, personal surety, cash, or negotiable securities of the United States will be required of the successful bidder prior to execution of the contract in accordance with Departments Regulatoin 43 CFR 3610.5. The $8,700 per-formance bond is required in order to I guarantee site protection, reclamation, removal of all litter, and compliance with all terms of the contract. The bond shall be released following termination of the contract and satisfactory compliance with the terms thereof. A mining and reclamation plan is required of the purchaser in accordance with 43 CFR 23.8(2). The plan must be approved by the Authorized Officer. Reclamation cost will be borne by the purchaser. Processing and stockpiling will be allowed on the site. However, no processing Involving large volumes of water which would require a water well or water Impoundment is allowed. The purchaser must provide the District Manager with monthly volume totals of materials removed from the site and periodic reports pertaining to operations, grading, backfilling and planting. The sale area is located 12 miles north of Bullfrog, Utah, in portions of SVi, Sec, 34, T35S, RUE, and NEV4, Sec 3 and Sec 4, T36S, RUE, Salt Lake Meridian, Garfield County, Utah. The site lies about 1 mile southwest of Utah 276 on a gravel road. The material to be sold consists of poorly sorted pediment cobbles, boulders and silt The successful bidder must submit the following before the contract will issue: Form 1140-8, Equal Opportunity Compliance Report certification; Form 1140-7, Equal Opportunity Affirmative Action Program Representation; Form 5450-9, Citizenship Affidavit; and Form 1140-6, Independent Price Determination Certificate. Any contract issued pursuant to this offer will be on Form 3600-5 and will be made subject to Departmental Regulations 43 CFR Part 23. The extraction, severance, injury, or removal of timber or mineral materials from public lands under the jurisdiction of the Department of the Interior, except when authorized by law and the regulations of the Department, is an act of trespass. Trespassers will be liable in damages to the United States and will be subject to prosecution for such unlawful acts (43 CFR 9239.0-7). NOTICE The staggered registration program could cause some misunderstanding for t.ose whose registration expires in December. If registrations are not renewed in December and the taxpayer waits until January to register his vehicle, he will b? subject to two years taxes instead of one. This is due to the fact that even though his registration expires in December, he is actually paying taxes for the calendar year 1979. In essence, he has had the benefit of a delayed payment. For those who purchased a vehicle in December of 1978, through the staggered registration program, the taxes are not paid until December 1979, however if taxes are not paid at that time and are paid in January, the 1 two years taxes are due, ' one tax for 1979 arid cne for 1980 as January will become the new registration date. To avoid confusion the tax commission suggests the registrations due in December be renewed at that time. The commission offered this explanation regarding the staggered registration. The lien date has not been changed from January 1. This date is actually the due date for the personal property taxes on vehicles, however, as a means of simplifying the assessing and collecting of such taxes, they are paid during the month the regtstraiton expires.
