Show "DISTRICT court. 'Tuck" and Frankie Now Say They're Guilty. i MR& DAVIS ARRAIGNED On an Indictment Accusing Her of Adultery Adult-ery With Charles M. Patten of Payaon Other Items of Business Transacted An Assault Case on Trial. Upon the opening of the First District Dis-trict court this morning the blooming pair of youths who creattd the little sensation at Pay son on February 12th appeared and listened to the clerk read an indictment that had been found against them, accusing them of the crime of fornication. Frtnkie Smith alias Fenstemaker, alias several other names, now wears the habiliment3 that usually adorn the female sex. She ia dressed in a neat dress of dark navy blue color and appears a dilferent person. "Tuck" Ockey has sobered up and looks as though he has had all the fun he wants out of his latest spree. At 2 o'clock the twain again appeared before his honor. Tuck pleaded guilty and said he was on a big spree when the offense was committed. The judge letcured him and sentenced him to (30 days in the penitentiary. Frankie pleaded guilty too, and said she was an orphan, thrown upon the cold world and had been living at Mercur. The judge also lectured Frankie and sentenced her to twenty days in the penitentiary. "And still women will howl for equality before the law," remarked a promment attorney almost al-most loud enough for all in the courtroom court-room to hear. Thomas Erwin was arraigned on an indictment charging assault with a carving knife with intent to do bodily harm upon the person of Thomas McKay Mc-Kay in Millard county, on October 1, 1894. C. F. Barrett was appointed to defend the man. Guy Madsen of Springville, indicted for fornication, was not in court and his bonds were forfeited. R. S. HineB waB awarded judgment by default against Nathaniel Williams for $1,664.55, $160 00 attorney's fee and costs. A demurrer was argued in the case of G. D. Killpack vs. George C. Whit-more, Whit-more, suit to collect school taxes in Emery county. Ten days time to amend complaint was granted. The case against Louis Madsen accused ac-cused of assaulting John Fury with a beer bottle at or near a saloon in the Detroit mining district on the night of December 26th last was taken up and is now on trial. Rachel Davis was srrainged upon the opening of court this afternoon. She has no money with which to pay an attorney, and no relatiyes or friends who will come to her aid. J. E. Booth was appointed by the court (to take cbarjre of the woman's case. She will plead tomorrow. She carries in her arms a babe only about a year old and looks pitiful indeed in her present predicament. John Schmidt of Mercur, accused of assault with a deadly weapon, was ar-rainged. ar-rainged. His case will be set for hearing hear-ing some day next month or later, as some of the witnesses for the defense are temporarily out of the territory. |
