Show FOUND GUILTY. Sliaoffer's Trial for Stealing" Steal-ing" Carpenter's Tools. Evidenco That "Clinches the Theft on to the De-! De-! fandant. Yesterday morning James Shaeffer. an old man aged 63 years, was before Justice Brown on a charge of larceny. The complaint alleged that on or about May 13th the defendant stole sundry carpenter's tools to the value of $40. belonging to one George Walters. D. D. Iloutz prosecuted and A. O. Sutherland defended. Geo. Walters testified that he had tools in a chest in the coal shed at the back of his place of business, and that on May 14 he had missed them. He had notified the officers of the affair. A box, containing thirteen bits, was among the tools. The box of bits was introduced in evidence and recognized recog-nized by the witness as the box, because be-cause of the hinge being broken, and also a pencil mark on the bottom of the box '-na-To," a private mark denoting de-noting the price- of the box when eniptv. -Nightwatchman Ilatton testified that at the time the tools were missing he had been notified, and a description descrip-tion had been given him. He had kept his eyes open sir.ee then, and on Wednesday got track of the box. He recognized the box from the description descrip-tion he hiid received. The box was at Mickel's lumber yard. John Bowler claimed to have bought it from Shaef-tir Shaef-tir for $1.40. Officer Wilkins and others followed Shaffer into Rock Canon and arrested him. John Bowhr testified that he bought the box of bits on Wednesday morning from Shaffer. A. L. Loveless identified the tools as 'ne he had seen in the hands of Iters ab nt three months ago, at a .iuie when Walters tried to sell them. Jam 's Shaeffer. r,h defpnrliint being sworn testified he had bought the tools three years ago; there was a box of bits, a saw, hammer, and a lot of other tools. He bought the outfit for $27. The brace belonging to the set of bits had been broken by someone, some-one, and the saw had been lent to a person who had forgotten to return it. He had done work with the tools all the time, or would have sold them sooner; every time he had use for a brace he made one out of a piece of wood. He accounted for the mark I '-ua-7.5" on the bottom of the box as the express charges for taking the box from one place to another. Witnesses were placed on the stand to ascertain the reputation of the defendant, but none could say anything any-thing good of him. - D. D.
