Smith of Salt Lake is ieuinR for some over 9,000 balance due on notes placed in hands of defendants for c- llection, further evidence for the prosecution was offered. H. S. Martin, of the firm of Swazey & Martin, bankers, gave testimony to the effect that Thomas J. Green was cashier of the National Bask of Commerce Com-merce in 1S!)2 and he (witness) was assistant as-sistant cashier. Two deposit tickets were identilied as were three letters in j , the hand-writing of the cashier. I These went to exDlain 6ix collections 1 w hich Cashier Earl testified to yesterday, yester-day, which were collected and credited to the National Bank of Commerce. The aggregate of theee collections wai something over $2 000 and tuey were made through the National Bank of the Republic, Sale Lake city. -Mr. Earl's testimony in reference to placing the money collected to the credit of the National Bank of Com merce which was stricken out was re- instated. Two collections on merchants of Farmincton amounting to some over 450 w ere ma Je exhibits in evidence. An acceptance of a draft on Mr. Huish of Tayson was put in evidence, this was tor $275, Exhibits thirty-six and thirty 6even gave evideuce of the collection of $290.7y and 11850.50 on lluiah & Sons, l'ayson. Another batch of collections made by the bank amounting to over $1000 was testilied to; these were made on business men living a bout Faruiingion. Bank received ol Whitmore, Nepbi, , $24.50 last October, other collections, 1 Wm. Jex, Spanish Fork, $121,12. I Above collections were made upon I drafts of W. H. Smith, j On cross-examination Martin eaid he recaived these collections sometime I last July- I George V. Mickle testified to having i paid a draft of $197.40; he also paid other drafts to Elint-r B. Jones, bis attention at-tention being called Mr. Green to the . fact that Jones had the paper and I 1 would receive the payment. Witness I gave an order on a third party in pay I ment. Amounts paid by him aggre- 1 gating $492.14. Evidence of many other collections made on the notes I and other evidences of dbt was of- fered and is slill being offered. |
