| Show ACCUSED OF fi FUL CRIME brakeman sa d to have thrown man under whee s of moving tra n james lynch was fata ly crushed under tl e wheels 0 a rio grande western fi eight train sunday morn ing and in his ante state ment 1 afo e lun judge howell cf 0 i stated that a braken an en tl e train 1 ad hurled him under the V a Is lynch albl 01 gh that ia not his real name had bee erving time as a va grant in the ode jail and was re leased to et out of town about 3 clock sunday morning he was p ck ed up on the track near poy and brought to ogden by a rio grande western train both his legs had been run over and one bad been crushed almost off was taken to the hosp tal the doctor pronounced the case hopeless and judge howely was sent for to take an ante mortem statement which lynch wished to make according to this statement lynch and another man whom he knew as dad mur phy were at the yards to board a southbound train when the brakeman who afterwards figured in the case wanted each man to give him 50 cents in order to get a ride out the men had no money but got on the train anyway slipping into one of the compartments of a refrigerator car A short distance out of ogden the brakeman came and fired a shot into the compartment without hitting either man at this lynch crawled out and the brakeman grabbed him and threw him between the cars he struck across the tail and the train crushed both legs above the knees he lost consciousness until he reached the hospital |
