Show 3 CLIPPER Friday, September 10, 1993 BOUNTIFUL HIGH SCHOOL Voland charged for daughter's death 33 months after incident The attorney FARMINGTON for a West Bountiful man arraigned recently for abusing and causing the Nov. 19, 1990 death of his daughter is asking why it took so long for the Davis County Attorney's Office to bring charges against his client. David Voland, 32, was arraigned in Farmington Circuit Court Sept. 1, on second-degre- e felony charges of manslaughter and child abuse. Voland's arraignment came 33 months after the death of his daughter, Diana, and more than two years after Bountiful Det. Lloyd Kilpack had concluded the police investigation of the incident. Voland's attorney, Walter Budgen Jr., wants to know why the county attorney's office waited until June of 1993 to bring charges against his client. I think that a fair conclusion to be drawn is that they have grave doubts about their case...and about the quality of the evidence they have that points an accusatory finger at Mr. Voland. What else can be the explanation for them to wait two years? They haven't done any investigation to speak of for two years. But Davis County Prosecutor Brian Namba said that his office needed the extra time to complete the investigation. We were trying to exhaust all the opportunities to get more evidence, he said. Voland has maintained his innocence. He told police that he and his wife were sleeping in their Bountiful home Nov. 18. He said he awoke during the night and checked on his daughter, finding her seeming lifeless in her crib. An autopsy conducted by State Medical Examiner Todd Grey concluded the victim had died from shaken baby syndrome. Grey also uncovered evidence of blunt force injuries of varying ages which CLASS OF REUNION Way of Davis County kicked off its 19th annual campaign Wednesday, Sept. 1. Campaign chairman and Phillips 66 Refinery Manager Jim Branch, announced a goal of $900,000 for the 1993 campaign. Achieving the goal would represent a 12 percent increase over the 1992 campaign in which $805,266 was raised. If successful, the 1993 total would represent the largest amount of money ever raised by the United Way of Davis County. In remarks made during the campaign kickoff luncheon held at Hill Air Force Base, Branch said that "even as we meet this campaign's goal, we can't possibly meet all of the county's critical needs. It's more important than ever for each of us to do our part to help those in need." According to Branch, the campaign is off to a great start. Pacesetter companies have already raised $109,338. Of the money raised, 99 percent will be used along the Wasatch Front to help 107 fund agencies and organizations. Pacesetter companies and their results: JC Penney Telemarketing, $25,300, a 21 percent increase over Bountiful last year; Auto-Sof- t, $3500, a first-tim- e campaign; Key Bank, four branches in Davis County, $1060; Clearfield Job Corps, $12,050; CT Film, Freeport Center, $3896; FHP, $2551, a 42 percent increase over last year, SPS Systems, Layton, $39,015, a 53.8 percent increase over last year; and HERO from the burning vehicle behind him was so intense Jenkins didnt think anyone could survive it. An additional 17 volunteers serve on the campaign committee. It is expected that more than 500 volunteers will be involved throughout the county. John Howard, vice president. Key Bank, the keynote speaker, emphasized the importance of setting goals and focusing on achieving those goals. Namba refused to divulge the nature of those injuries, saying he couldn't go beyond what was in the probable cause statement. Prosecutors also claim in the statement that Voland and his wife were the sole caretakers of their daughter and no one else had sufficient exposure to Diana...to have inflicted all the injuries. Budgen said his client, who now lives in West Bountiful, is steadfast in asserting his innocence. We're going to have our day in court and let a jury decide, he said. Judge S. Mark Johnson has ordered the case bound over trial in 2nd District Court. Voland's arraignment hearing in district court is set for Sept. 28. ' And the burglar realizing he had been caught in the act...went along with it., Kilpack added. They went into the front room. The burglar sat down on the sofa and they talked for a while. Police said the youth was so shaken by the encounter he waited for three hours after the burglar left, until his brother got home, to explain what happened. I had a copy of the composite drawing and knocked on the door of an adjoining apartment to see if they had been a victim as well and there was the suspect sitting on the couch," Kilpack said. The man was arrested after the witness positively identified him as the burglar. The suspect listed the apartment as his address, but police doubt that is true.
