Spencer and Alice Webb attended the Dixie Roundup at St George and they also visited with Jay Webb and family Dean and Jackie Black went to Salt Lake City on Thursday where they visited with Waldo Montana at the home of her daughter She was born January 8 1903 in Raymond Alberta Canada to William Lucine and Clara Mariah Clark Cook She married Norris Elbert Bidgood September 21 1927 in Fillmore Utah He died January 9 1977 She attended school in Cedar Fort Utah moved to Nebraska after her marriage and returned to the Delta area in the fall of 1941 She was an active member of the LDS Church aspecial-lthe Relief Society She loved to quilt She moved to Montana after her husbands death She it survived by daughters Mrs John (I oris) Davis Riviera AZ and Mrs Wally (Gerry) Croft Ronan MT and AMENDING SECOF THE REVISED ORTION DINANCES OF DELTA CITY (1981 EDIMAKING TION) AS AMENDED TECHNICAL CORRECTIONS TO THE SECTION PROVIDING FOR PROPER EVIDENTIARY PROCEDURE TO SUPPORT AN ACCUSATION OF THEFT AND ENACTING A NEW SECTION ENTIT1ED "RETAIL SECTION THEFT" DEFINING ACTS CONTHEFT RETAIL STITUTING ESTABLISHING PROCEDURES FOR THE DETENTION OF SUSPECTED VIOLATORS BY MERCHANTS PROVIDING FOR PROPER EVIDENTIARY PROCEDURES PROVIDING A PENALTY FOR VIOLATION OF THIS SECTION AND SETTING FORTH THE PROCEDURE FOR REPORTING A VIOLATION OF THIS ACT TO THE STATE OF CRIMINAL BUREAU IDENTIFICATION The City Council of the City of Delta Utah referred to herein as the "City Council" recites the following as the basis for enacting this ordinance A Delta City has jurisdiction under the laws of the State of Utah to enact ordinances the violation of which will subject a person or entity to criminal sanctions and Delta City has exercised said power by adopting ordinances as set out in the Revised Ordinances of Delta City (1981 edition) as amended and other enactments of the ty Council B The City Council has heretofore adopted a "theft" ordinance establishing various classifications of theft and providing for the proper evidentiary procedures to support an accusation made pursuant to the theft ordinance C The City Council desires to prevent any uncertainty as to the intent and proper application of the evidentiary procedure used to support an accusation of theft as it relates to Section through Section of the Revised Ordinances of Delta City (1981 edition) as amended and therefore desires to make technical correcof the Revised Ortions to Section dinances of Delta City (1981 edition) as amended as it relates to the evidentiary procedures D The City Council has determined that there is an increasing amount of retail theft in the stores or retail mercantile establishments in the Delta Utah area and desire to adopt a retail theft ordinance to enable the City to file criminal charges and to prosecute those persons arrested for retail theft E The City Council has determined that it is in the best interests of the residents of Delta City and will promote the health safety and general welfare of Delta City to adopt a retail theft ordinance to protect the merchants of retail mercantile establishments in Delta Utah NOW THEREFORE BE IT ORDAINED by the City Council of the City of Delta Utah: Section Theft Evidence to Support Accusation Section of the Revised Ordinances of Delta City (1981 edition) as amended is hereby amended by deletion of the material marked by an overstrike and addition of the underlined material to read in its entirety as follows THEFT - EVIDENCE TO SUPPORT ACCUSATION Conduct denominated theft in this part constitutes a single offense bracing the separate offenses as those theretofore known as larceny larceny by trick larceny by bailees embezzlement false pretense extortion blackmail and receiving stolen property An accusation of theft may be supported by evidence that it was committed in any manner specified in sections through possession unpurchased merchandise and to make reasonable investigation of the Revised Ordinances of Delta City (1981 edition) as amended subject to the power of the court to ensure a fair trial by granting a continuance or other appropriate relief where the conduct of the defense would be prejudiced by lack of fair notice or by surprise Section 2 Retail Theft The following provision is hereby enacted as Section of the Revised Ordinances of Delta City (1981 edition) as amended: RETAIL THEFT A Definitions as used in this of such of the ownership merchandise 2 To requet identification 3 To verify such identification 4 To make a reasonable request of such person to place or keep in full view any merchandise such dividual may have removed or which the merchant has reason to believe he may have removed from its place of whether for display or elsewhere amination purchase or for any other reasonable purpose 5 To inform a peace officer of the detention of the person and surrender that person to the custody of a peace officer 6 In the case of a minor to inform a peace officer the parents guardian or other private person interested in the welfare of that minor immediately if possible of this detention and to surrender custody of such minor to such person A merchant may make a detention as permitted herein off the premises of a retail mercantile establishment only if such detention is pursuant to an immediate pursuit of such person D In any action for false arrest detenfalse imprisonment unlawful tion defamation of character assault trespass or invasion of civil detainrights brought by any person ed by the merchant it shall be a defense to such action that the merchant detaining such person had probable cause to believe that the person had committed retail theft and that the merchant acted reasonably under all circumstances E Photographs of items allegedly taken or converted - admissibility - procedure As used in this section "items" means goods or merchandise as defined under subsection B above 2 In any prosecution for a violaB photographs of tion of the items alleged to have been taken or converted are competent evidence of the items and are admissibile in any proceeding hearing or trial as chapter "Retail value means the merchant’s stated or advertised price of the merchandise 2 mercantile "Retail establishment" means any place where merchandise is displayed held or offered for sale to the public 3 "Merchandise"means any perheld or ofsonal property displayed fered for sale by a merchant "Merchant" means an owner or operator of any retail mercantile establishment where merchandise is displayed held or offered for sale and includes the merchant’s employees servants or agents 5 "Premises of a retail mercantile establishment" includes but is not limited to the retail mercantile establishment any common use areas in shopping centers and all parking lots or areas set aside for the benefit of those patrons of the retail mercantile establishment 6 "Minor" means any unmarried person under 18 years of age 7 "Shopping cart" means those push carts of the types which are commonly provided by grocery stores drug stores or other mercantile establishments or markets for the use of the public in transporting commodities in stores and markets from the store to a place outside the store 8 "Peace officer" means an officer as described in Section UCA (1953) as amended cluding a member of the highway patrol and 9 means to cause the cash register or other sales recording device to reflect less than the retail value of the merchandise B A person commits the offense of retail theft when he knowingly: Takes possession of conceals carries away transfers or causes to be carried away or transferred any merchandise displayed held stored or offered for sale in a retail mercantile establishment with the intention of retaining such merchandise or with the intention of depriving the merchange permanently of the possession use or benefit of such merchandise without paying the retail value of such merchandise or 2 Alters transfers or removes any label price tag marking indicia of value or any other markings which aid in determining the value of any merchandise displayed held stored or offered for sale in a retail mercantile establishment and attempts to purchase such merchandise personal- or in consort with another at less than the retail value with the intention of depriving the merchant of the retail value of such merchandise or 3 Transfers any merchandise held stored or offered for displayed sale in a retail mercantile establishment from the container in or on which such merchandise is displayed to any other container with the tention of depriving the merchant of the retail value of such merchandise or 4 with the intention s of depriving the merchant of the retail value of the merchandise or J Removes a shopping cart from the premises of a retail mercantile establishment with the intent of the merchant of the possesdepriving sion use or benefit of such cart C Any merchant who has probable cause to believe that a person has committed retail theft may detain such person on or off the premises of a retail mercantile establishment in a reasonable manner and for a reasonable length of time for all or any of the following purposes: To make reasonable inquiry as to whether such person has in his ly if the items themselves were introduc- ed as evidence The photographs shall bear a written description of the items alleged to have been taken or converted the name of the owner or the store establishment or library as appropriate where the alleged offense occured the name of the accused the name of the arresting peace officer the date of the photograph and the name of photographer 4 The writing shall be made under oath by the arresting peace officer and the photographs identified by the of the photographer Upon signature the filing of the photograph and writing with the authority or court holding the items as evidence they shall be returned to their owner or returned to the proprietor or manager1 6f the Store or ’Establishment or to an employee of the library as is appropriate F A violation of this chapter shall be punished in accordance with Section Utah Code Annotated (1953) as amended Section 3 Effective Date This ordinance shall become effective upon publication Section 4 Publication This ordinance is ordered published in the Millard County Chronicle Progress a newspaper having general circulation within the City of Delta Utah Section 5 Severability In the event that any provision of this ordinance less than the entire ordinance is held invalid by a court of competent jurisdiction this ordinance shall be deemed severable and such finding of invalidity shall not affect the remaining portions of this ordinance Section 6 Repeal of Conflicting Ordinances To the extent that any ordinances resolutions or policies of the City of Delta conflict with the provisions of this dinance they are hereby amended to be in accordance with the provisions hereof PASSED
