to felony child abuse In return for the plea prosecutors agreed not to charge Gunter with murder should the child die "The physicians say he will nev- e'r develop beyond a child-lik- e state" said prosecutor Jim Jenkins Defense attorney Robert Gutke told Judge Clint Judkins "there may be a death resulting from the injuries" The boy is currently in foster care Mr Jenkins said Gunter admitted to throwing the infant "because of frustration" At the time of the incident Gunter was living in Logan with the boy's mother but moved to Boise Idaho where he was arrested In exchange for Gunter's guilty chose not to present any witnesses and instead played for the jury the tape of Mr Price's 911 emergency call reporting he had just shot his girlfriend Mr Price is charged with the murder of Katherin Scott 25 who was shot in front of her West Ogden apartment shortly after midnight Jan 5 1992 Price drove to a nearby gas station and called 911 On the tape Mr Price identifies himself to the dispatcher and tells her he has just shot Ms Scott and left her lying in the street "I'm so sorry" Mr Price says claiming the killing occurred during an argument about the couple's daughter who slept nearby in Ms Scott's car However prosecutor Kristine Knowlton in closing arguments told the jury that Mr Price "intentionally and knowingly" committed the murder She said Mr Price had driven from Salt Lake City to Ogden that night armed with a semiautomatic pistol to harm his estranged girlfriend Defense attorney Steve Laker whose summation will be completed today stressed Mr Price's "out of control state of mind" The lawyer asked the jury to remember that several witnesses testified the defendant was "extremely agitated upset and angry" during the shooting and tearful and "making no sense" afterward Mr Laker said Mr Price always carried a gun when he came to see his daughter because of threats against his life by the victim's relatives The jury is expected to begin deliberating
