STORE OPEN SUNDAY AS CASH TfRrtmT Developer Contests Sewer District Fees legal challenge to fees assessed Lakes special sewer districts has been filed by a major real estate developer who contends the amounts are excessive and unrelated to costs. The suit was filed by F.C. Stangl III, a commercial developer reportedly responsible for more than a million square feet of developmert in Utah during the last decade. Mr. Stand's 3rd District Court action contests action by the Salt Lake City Suburban Sanitary District No. 2. The district, run by Salt Lake County, sets fees and charges developers for sewer connections. Mr. Stangl beA pointed out that if a property is deemed to put an abnormally high load on the sewer system, a surma rge is assessed. This forces some construction projects to subsidize others, the suit said. Further, he questions why the spirit of increased costs is not applied for developments which will add minimal stress to the sewer system. Nothing exists to reduce fees, the complaint stated. Add No Stress On his own buildings, Mr. Stangl noted, areas that will add no stress to the sewer system were included in the square footage calculation determining his fees. Among these was the buildings parking lot. Mr. Stangls suit said he has already paid the sewer connection fee on five buildings. Those were paid under protest and totaled $48,121. Now he has another building, this time at 200 W. 7200 South in Midvale, and he has filed the suit to resolve his dispute with the district and correct what he sees as overcharges for the others. Another section of the complaint deals with sewer district autonomy Mr. Stangl states that when he went to contest the fees assessed against one of his buildings, he was denied a hearing. Although most of his suit is aimed at the policies of the district, portions of it are directed at the board of trustees for the district. Those board members, past and present, are named as defendants for their role in the Salt Lake City Suburban Sanitary District No. 2. They are Calvin A. Brady, Eldon V. Carter and J. Draney Smith and former member Marion H Brady. The suit does not ask for monetary damages against the officers. Michael J. Mazu. an defended the district in the short-live- d federal suit. The district has performed careful analysis in the past to avoid that specific thing, he said when told of the new lawsuit. The district has made every effort to assess people on a fair and equitable basis, he added. Mr. Mazuran said he preferred not to discuss specifics of the case because he had not yet seen it and because it might differ from its federal version. Mr. Stangl claims the district unfairly assesses its charges. Fees on commercial properties are assessed according to how much residential land is consumed by a development. Mr. Stangl believes commercial properties should have a different standard. His 3rd District Court lawsuit says the practice violates a Constitutional guarantee to equal protection. He further charges that rates improperly vary among commercial properties.
