Show DISTRICT COURT IN SESSION Case against Emery White and Joseph Stokes Takes Up Greater Part of Week, Resulting in a Hung Jury-Hill Case Next The trial of the case of the State of Utah vs. Emery White and Joseph Stokes has taken the attention of the district court nearly all the week. The trial ended with a hung jury,, there being be-ing an equal division of the eight men on the question. Such being the outcome of the case District Attorney Woods moved for a dismissal of the case with the understanding under-standing that if granted the boys would be re-arrested at once on a charge of less severity. The case was accordingly according-ly dismissed and the boys again arrested. ar-rested. Their hearing in the lower court is set for November 16th. They gave bonds for their appearance and ' have gone home to enjoy a respite from trie ordeals of a court room. i It will be remembered that these boys were arrested at Provo last April, to wnicn place they had fled following the alleged offense of ravishing Mis; Lucy Richards, a 14 year-old girl at Cleveland. The boys have been undei bonds since that time. The case has attracted considerable attention on account ac-count of the boys being only 18 and 19 years of age respectively and the heavy punishmenc in store for them in case they had been found guilty. The case was prosecuted by District Attorney F. E. Wooifod County Attorney Dickson with S...A. King and C. C. McWhinney defending. Every phase of the trial was closely contested and every witness closely cross-questioned. About fifteen witnesses were examined ex-amined and the case exhaustively argued by Attorneys Woods, McWhin-ney McWhin-ney and King. The case went to the jury shortly before noon Thursday and it was the middle of the forenoon Friday before all hope of a verdict was given up and the jury discharged. The case was then disposed of as above stated. The charge against the boys under the present arrest is "carnal knowledge" which is punishable by a much less pen alty than the offense for which they were tried. It is supposed that they will plead guilty to this when the tim comes for the next trial, however wha I they will do will be found out when that time comes. The jury at the hearing this week was as follows: Heber P. Brockbank, Frank N. Guymon, Riy Cox. Peter Johansen. Andrew Rasmus-sen, Rasmus-sen, W. A. Staker, W. C. Beh unin, Willard Peacock. During the time that the jury was out On the above case; the case against Robert W. Hill was brought up and . after the preliminary motions and arguments the task of getting a jury was begun. The regular venire was soon exhausted and a special venire was issued and the following summoned as quickly as possible: Thomas Jones, Wm. A. Maxfield, John H Judd, Fred E. Larsen, Miller S. Black, O. W. Sitterud, Peter I. Ake-lund, Ake-lund, Henry A. Seely, Chri.ss Ottesen, John C. Duncan, Lewis Johnson, U. W. Grange, John S. Lewis, Guy M. Nelson, Andrew Nelson, Ernest E. Davis, Joseph Jos-eph Barney, Joseph H. Jewkes, John E. Leslie, Martin Jensen, John W. Long, Jasper N. Robertson, John B. Broderick, Seel Conover, Len Huntington, Hunting-ton, Clarence Lemon, Alma E. Larsen, J. E. Howard, Richard Keel, Adelbert Oviatt. As we go to press the examination of jurors is in progress and the chances good for considerable time being speut before the panel is completed. District Attorney Woods and County Attorney Dickson are being assisted in this case by Judge S. R. Thurman of Salt Lake. J. W. N. Whitecotton of Provo is attorney for Mr. Hill. A large number of witnesses from all along the road east as. far as Kansas City are in" attendance, and some of them have been very impatient at the long delay ' of waiting for the hearing of the case from Cleveland. The case of the Independent Canal i j and Reservoir Company, a corporation, I vs. the Emery County Land and Water Company, a corporation, to determine water-right has been set for a special .session. The special session will be held commencing November 15th if there is no term necessary at Monti-cello Monti-cello at that time. If the regular term ! is necessary at Monticello the special I session here will be held commencing .! December 12th. j A full report of the cases and their j dispositions will be given next week. ! Later: Before the adjournment of ; the court yesterday six jurors had been ! secured and from the large number summoned who had not yet arrived the other two can surely be selected. This seems to assure that the Hill case will be on trial today. |
