WENDY'S SEEKS TO RECOVER UNTESTED BURGER MEAT: Wendy' s International Co., the nation's No. 3 ham burger chain, is looking for some of the 8,000 pounds of beef that were shipped without proper testing for bacteria. Wendy's sa id Friday tha t its meat distributors had recovered 90 percent of the untested beef, which was sent to 900 fast-food outlets in Michigan, Minnesota, northwest Ohio, Chicago, Wisconsin and Kansas City, Mo. The rest had either been eaten or was unaccounted fo r. Both sides suffer loss in Simpson case LOS ANGELES (AP) - The judge in the 0.J. Simpson case, convin ced that prosecutors purposely delayed sending evidence out for DNA testing, refused to hear further arguments on the issue and hinted that he might bar some of the test results. Lead prosecutor Marcia Clark tried Friday to explain why testing had ta ken so long, but Superior Court Judge Lance Ito wouldn' t listen, saying he already heard enough from the prosecution's DNA expert on Tuesday. " How often do I have to hear these arguments?" Ito asked. Simpson's lawyers say the delays were designed to deprive them of time to do their own tests. Ito is scheduled to rule today whether to allow DNA tests on blood taken from Simpson's Bronco, his driveway and a glove found outside his estate to be admitted as evidence. The judge has said he is inclined to throw out any test results that arrive after opening statements to the jury, which could begin in mid-November. Defense a ttorneys also lost a significant battle Friday. Ito refused their request to hold hearings to find the source of news leaks in the case. Simpson 's lawyers claim the leaks have hurt his chances for a fair trial. Deputy District Attorney Marcw Clark was denied reopening evidence delays issue. Simpson, 47, is charged in the June 12 slayings of his ex-wife Nicole Brown Simpson, 35, and her friend Ronald Goldman, 25. With no eyewitnesses, the prosecution is relying heavily on scientific analysis of physical evidence to link Simpson to the crime. Clark tried to give Ito a thick sheaf of papers, presumably in cluding test results, to show why testing has taken so long.
