Show Wednesday, May Sun Advocate, Price, Utah 3A 1, 1985 For building permits County commission adopts fee schedule addresses, etc. By DALE EDWARDS Staff writer 1 Bie Carbon County Commission last Thursday voted to approve a new building permit fee schedule which will clarify a mistake in the old ordinance that would cost the county set-dow- dearly. The county earlier adopted a standard building valuation code by ordinance. County Clerk . Norman Prichard said the ordinance allows for changes in the fee schedule for permits to be adopted by the commission by resolution rather than passing a totally new ordinance. Building Inspector Murray Shorts said the fees as specified earlier needed to be changed. He said the need for the change was brought to light because of an error which has caused a problem for the county and for Getty Oil in the last few days. Shorts said the resolution is to include amendments in the ordinance that will make the entire ordinance better. The error which affects Getty is a typographical error in setting the fees for large contraction projects. The ordinance earlier specified a minimum building permit fee of $6,000 for large projects plus .005 percent of the value of the project over der. -- Mike Dmitrich, representing Plateau Mining and Getty Oil, asked what fees had been attached to the resolution for major construction projects. After showing Dmitrich a copy of the proposed fees, which contained the higher percentage fee for large construction projects, Shorts said it was only fair that the higher fees be charged. When you look at it, a person building a $100,000 home would be charged $1,000 for a building permit. Then, under the old figures, a company building a $9.5 million project would only be charged $6,450 for its permit. Its not fair, he said. Dmitrich said while he could $500,000. Shorts said the fee schedule support a higher fee than the should have specified a fee of .5 $6,450 total, he thought it would percent of the value of the be unfair to raise the fee to project over $500,000 plus the $51,500. I believe if there is a $6,000 minimum $6,000 fee. The difference in the cost for minimum fee there should be a building permit fees for Gettys maximum fee as well. Its just not fair to charge $51,500 for a construction project is considerable. Under the earlier building permit when the payer, figures Getty would have to pay Getty Oti, receives no benefit $6,450 in permit fees on the $9.5 from it, he said. million project. Shorts said the county has had problems with trailer parks because people move in quickly and with no one knowing. He said with the countys addressing system officials felt a n fee was needed to $25 allow the county to keep track of these people and get them their set-dow- he added. He pointed out that, the $9.5 million project will increase Gettys property tax burden by $15,000 in 1985, by $100,000 in 1986 and by $164,000 in 1987. You can call it a fee or whatever you want, but whatever you call it, it is still double taxation. We have no problem with your charging a fair and equitable fee, but I do think this is unfair, Dmitrich Prichard reviewed the reasons that fees were established by the commission for planning and zoning and building services in the first place. Last year we created a municipal services fund. We were going to set a mill levy to take care of fire protection, planning and zoning, animal control, etc. , he said. But we got massive protest on all of the services with the exception of fire protection. The mines and those in unincorporated areas of the county said let the fees take care of the services. Now Im not saying the $51,500 fee is what it should be. But the fees pay for the services all procedures, implied consent, presumptions and punishments under the motor vehicles act. Walsh said if a person is arrested for violating the law the registration of the vehicle can be suspended or revoked, but licenses of operators can not be revoked since licenses are not required. (Continued from Page 1A) became necessary. Furthermore, Taylor praised the work being done by Emery Mining in its efforts to recover the mine. He said that UP&L had just renewed contracts with Emery Mining for management of the mine. Weve not changed ; : ; i ; ; i that about organization and the miners who work there. We still have full confidence in them, he said. However, he said there was some concern following the fire that there would be some apprehension about going back into the mine on the part of management. We appreciate the fact that Savage Brothers and the . workers are back at doing their jobs, he said. Emery County Commissioner Clyde Conover then told the UP&L president about the countys efforts to get legislative funding to help with the roads which have been I etc., of recreation vehicle facilities and for the administration and enforcement of the act. improvement, traffic. impacted by coal-haHe asked for UP&Ls support in lobbying efforts at the June legislative session, and Taylor said that company officials would meet with county officials to review the matter. Well I agree the $51,500 is high. In fact it is astronomical. But we have to meet the expenses of the department and make up for last years deficit. Prichard work with you on that, he said. Friday Taylor toured the Wilberg mine to inspect work there and was given a briefing by Bill Zeller of Emery Mining. Officials noted that teams Thursday night had made excellent progress by advancing to No. 10 Crosscut in First Right to complete section a thousand-foo- t reclamation, leaving just 500 feet between teams and First North, the main entry leading to Fifth Right where the bodies are located. morning, fee of or $20,000? $15,000 Dmitrich asked. If there was a $20,000 maximum we wouldnt be down here discussing it with you. Prichard said he felt the maximum seems fair. We could write this into the ordinance and pass it today, he $20,000 said. Commissioner Floyd Marx said he felt the idea of the maximum fee is fine, but I wonder if were ready to put a dollar figure on it right now. Commissioner Guido Rachiele agreed. He said he felt the resolution should be passed with the understanding that there were reservations on the maximum fees that could be charged. He said those could be discussed and added at a later time. With that understanding the resolution passed unanimously. 503320 GtorOto ocBBoma aHr(T)T) 6 uu m Ui 3 Legged Chickens Chicken Breasts Whole Chicken ib.69 ib. 95 Family Pak legs Family Pak. . . He said that cooperation extended from all areas helped the company make a smooth transition from the Wilberg mine into the spot coal market when coal contracts mind account in the general fund for use by the Division of Parks and Recreation in the construction, restricted Dmitrich said he realized that. I appreciate that. And thats all the more reason we should have a maximum. Is it fair to tax to that degree a company that is one of the largest employers in the county and is in a highly competitive market? The $50,000 may not seem like so much, but $50,000 here and $50,000 there may put us out of that competitive market, Dmitrich argued. Shorts and Prichard then asked Dmitrich what he felt the fee for large projects should be. You have a minimum fee of $6,000, how about a maximum Come to where the Savings are Rea- l- not just talk! Well, fortunately we didnt have any fires either and the county was able to spread the money around and keep the fund solvent. But there is still a deficit in the building department and until we get enough surplus to retire the deficit and see that they have enough to pay the expenses of the department, we have to charge the fees, he said. Dave Levanger, who doubles in the building and civil defense departments for the county, said the new fee would also insure that mobile home owners get proper sewer hookups. Prichard said a printout of n those fees should also ' be provided to the county assessor to help keep track of mobile homes for tax purposes.
