The Estes Company has revised plans for its proposed major shopping mall at 5400 South Redwood in an effort to get approval from someone and get the project moving again. The revised plans could see the project reduced in size by as much as the elimination of one of the major anchors and capitulation to a County Planning Commission concern over traffic access from 5400 South. one-thir- The original plans call for 350,000 square feet of retail space in the 426,000 square foot project. However, the Planning Commission rejected a rezoning request for the 35 acres because of site plan and because they claim their incorporation petition was put forward before any of the other entities actions. They say if the area is incorporated, the 141 acres would be in their city limits. Meanwhile, Estes is caught in a thee-wabattle between Murray Cy ity, Salt Lake County and Taylorsville, a battle that may end up in court before being resolved. mission granted conditional use approval to Busch Development which s is planning a store at Char-main- 5380 So. 4015 West. The City Council has put the request on hold because the county is protesting the request before the County Boundary Commission. Backers of the proposed Taylorsville-Bennioincorporation petition have lodged a protest to the whole situation of the Estes project was put forward by the County Commission, which has requested a Planning Commission recommendation before ruling on Estes appeal of the Planning Commission rejection of its rezoning request. Receiving some kind of county approval would allow the project to move forward while the three government entities try to resolve which will ultimately have jurisdiction over the property, incorporated, annexed or left alone. Brown said the councils vote does not indicate its support of the proposed office building development. The City Planning Commission will likely consider the E. F. Properties proposed development during a meeting in the near future inability to render municipal services to the annexed area. "The annexation is invalid as the territory proposed for annexation because it is included within the inarea of the Taylorsville-Benniocorporation which was initiated prior to initiation of the annexation, the letter also says. Hart said the commission has 60 days to schedule a hearing and an additional 20 days to make a decision. If the Boundary Commission approves the annexation, the council will then decide the issue.
