Show In West Valley Court Small Claim Cases At Highest Total WEST VALLEY. The number of small claims cases filed in West Valleys Justice of the Peace court more than tripled during March, reaching the highest total in the citys history. The marked increase - from 23 in February to 83 in March - coincided with the end of the state legislative session, a conclave in which West Valley became part of the circuit court system and the law governing the filing of small claims was revis-- ed. Court officials, both in West Valley and at the State Court Administrators office, were unsure whether the legislative changes were responsible for the increased filings but did not dismiss the possibility that it may have had an effect. In the period prior to March, an average of 33.7 small claims cases had been filed each month; since the court went into operation in July, 1980, the average has been 29.3 cases per month, court figures show. Several factors are probably behind the sharp increase, speculated court civil clerk Marian Graves. Although the deal has been consummated between Salt Lake county and the LDS church concerning the disposition of the old Magna ward house, it will likely be the first of next year before the building will be open for use. According to Ron Boren, county recreation program director, the county is in the process of choosing a consultant to work on remodeling the building to bring it up to code. In the meantime, the county is drawing up a comprehensive program of operation that will include the entire community, not just the youth. Boren went on to say that John Moore, former director of the Elks Boys and Girls Club in Salt Lake, will oversee activities at the facility and is currently compiling statistics concerning the numbers of young people and adults who will be using PTA At Orchard Is Sponsoring Carnival - HUNTER. Construction activity remained 22-- 3 times ahead of last years pace, according to city building permit figures for March. Permits were issued here last month for 91 projects with an estimated valuation of $1.8 million. That compares to only 38, with a valuation of $892,000 the previous March. The months figures bring the total for the first nine months of the fiscal year (which started July 1) to 760 permits for buildings with a valuation of $31.3 million. That far exceeds last years figures which, for the same time period, amounted to 237 permits for structures valued at $11.7 million, reported Chief Building Inspector Brent Snyder. Three-quarter- s of the March total ($1.4 million) involved residential construction. Permits were issued for 36 new single family homes with a valuation h of $1.3 million. She said that all but about a dozen of the small claims cases during March were filed by businesses which would be in a position to know and pay attention to the small claims law. The changes are not entirely precise - the language may conflict with other portions of the law. Primarily, they appear to make it more difficult to file numerous small claims monthly, said Fred Oswald of the Court Administrators Office. The law will permit people or businesses to file an unlimited number of claims, but it also gives the judge authority to reschedule all but the first, depending on the court load, Oswald said. Thus, if a business (for example) files small claims against five individuals and, after that, a person comes in with a single case, it appears the court would be obligated to handle one of the businesss claims and then the individuals before returning to the businesss subsequent cases, Oswald indicated. Another portion of court law, however, stipulated that courts are supposed to act on small claims cases within 20 days, he pointed out. He also stressed that there will be a child day care center, in addition to other agencies. Right now we are looking for volunteer leaders to help supplement our professional staff, Boren said. We expect to have a good program operating there six days a week, depending on the staffing and the way the program develops. Boren noted that lack of funds to develop more parking makes it necessary to make do with the available space in the existing lot. However, he added that he intends to see that the new facility will be a good neighbor to people living in close proximity. Obtaining payment of unpaid bills through court action is one means of doing so, Mrs. Graves said. Similarly, the court has handled a larger number of eviction notices in recent months. Five eviction cases were filed during March, the same number as the month before, records show. Mrs. Graves noted that she has seen an unspecified but large number of three-da- y eviction notices which have been sent out by landlords. Most are resolved before reaching the need for court action, she added. In other areas, the courts March report showed that fines totaling $16,361 were imposed during the month.
