Fourth District Judge Allen B. Sorensen has ruled against Lynn A. Jenkins, Salt Lake City, in a lawsuit filed against the Wasatch Board of Education in Heber City, and Lorin E. Allred, school teacher serving in the Utah Legislature from thatdistrict. Jenkins, a property owner in Wasatch County,filed the actionto prevent the Wasatch Board of Education from paying Allred a nine percent abrincrease or any compensation or benefits fot the period ofhislegislative term from jan. 1, 1979 to Dec. 31, 1980. HechargesthatAllred voted in favor of SenateBill 345, which authorized the schooldistricts to grant the nine percent increases. On March16,1979, Jenkins petitioned the Wasatch Board of Education not to retain, but to terminate Allred’s employment,claiming his employment as a teacher and his service in the legislature constitute a direct conflict with the separation of powers doctrine of the U.S. Constitution. Jenkins asked the court to declare the Weighted Pupil Unit provision and other provisions of SB-345 unlawful and to restrain the defendants from enforcing it and paying unlawful moneyto AlIred, presently or in the future. Hefurther asked the court to remand back to the Utah State Legislature the provisions of SB-345 to correct and delete it. Jenkins asked the court to determine that he is not required to pay any additional or increased property tax in Wasatch County, or elsewhere in the State of Utah, as a result of SB-345. Jenkins asked the court to issue an extraordinary writ prohibiting the Wasatch Boardof Educat‘on from continuing to pay Allred compensation or benefits of any type while heisstill a member of the Utah Legislature. In his decision, Judge Sorensen Stated that he found nothing which would support a finding that the plaintiff does not have a speedy and adequate remedyatlaw, or that he would suffer irreparable harm without the writ. Hethen granted the defendant's motion to dismiss the action, stating the court “need not reach other issues rasied by the complaint and defendant’s motions.” Judge Sorensen said a remedy under the law sould involve paying taxes under protest and suing for recovery.
