This study required two years to complete at a cost of SI. 5 million. Fourth, water that does form on the land in question is runoff water from storms and irrigation upland and is only prevalent during the late spring and early summer months. During the remainder of the year, the property is so bone dry that dust rises three feet high when you kick the arid dirt. BUT THIS IS exactly u hat is happening, in my opinion, to Owen Harwood of Boun- tiful and M.C. Green, Centerville, who owns approximately 18 acres of raw property in west Centerville w hich is being challenged in Federal Court in Salt Lake City as being wetland. Until the last few months this reporter had never heard the term wetland, and it wasn't until the past few weeks that I learned what the term means and the power that the U.S. Corps of Engineers has to enforce the law. FIFTH, THE property is I i miles from the marshlands used for wildlife protection and habitat and is separated from these marshes by the trestle of the Denver and Rio Grande Railroad tracks. Yet, the property is termed by the Corps of Engineers as being a navigatible waterway" which underthe corps own definition means: IVE SPENT more than six hours talking to representatives of the Corps of Engineers and others regarding the federal lawsuit of the United States of America vs. Owen R. Harwood and Milton C. Green. But nothing has changed my mind. I still feel that the U.S. Corps of Engineers think that they must prosecute this case despite some very vague definitions as to the meaning of "wetlands, and how it pertains to properties in Utah. IT WILL BE a test case in this state and is being bitterly contested in Utah by Gov. Scott Matheson, Senators Orrin Hatch and Jake Garn and the State Attorney Generals Office. The latter will be defending Mr. Harwood and Mr. Green when the case finally comes to U.S. District Court for Utah sometime later this year. The term wetlands as defined in one paragraph means: THOSE AREAS that are inundated or saturated by surface or ground water at a frequency and duration sufficient to support, and that under normal circumstances do support, a prevalence of vegetation typically adapted for life in saturated soil conditions. Wetlands generally include swamps, marshes, bogs and similar areas. Now lets take the Harwood-Gree- n and see if it, in any property way, complies to the Wetland Act. FIRST, THE property is located adjacent to the already developed Centerville Inwide unimdustrial Park. Only a in question land the road separates proved with buildings of the Industrial Park. Second, the property is zoned for commercial use and the concept for future development of the property for storage, light step-by-st- 50-fo- ot , THOSE WATERS of the United States that are subject to the ebb and the flow of the tide shoreward to the mean high water mark and-o- r presently used, or have been used in the past, or may be acceptible to use to transport interstate or foreign commerce. Now, how in the devil can any stretch of the imagination consider the property west of Interstate Highway 15 and east of the D&RG Railroad tracks as navigable waterway under their (Corps of Engineers) own definition? THIS CASE came to light about a year ago when a representative of the Salt Lake Branch, Corps of Engineers, spotted a truck dumping fill dirt on the Harwood-Gree- n property. The fill was to be used to prepare the land for future development. The Corps of Engineers rep approached the driver and asked if lie had a permit for the work he was doing. The permit, he said, was to have been obtained from the Corps of Engineers in Sacramento, Calif., because it was in violation of Section 404 of the Clean water Act of 1972 to dump fill dirt on property that could be considered wetland. They say they are taking the pair to court on alleged violation of two laws within Section 404 of the Clean Water Act because they did not obtain a permit from the corps before placing fill dirt on or near possible "wetland property and later by dredging a channel to drain the property in question without permission from the corps and because the dredge from the channel was not removed to upland (dryland) for deposit. I WAS absolutely shocked when told that I had violated a federal law. City, county and state officials that I contacted even after I was cited were not aware of the Wetland Act, only that it existed, but they did not know any specifics. I did what I thought was right, and when I was cited with the notice to cease and desist, t did not comply because I thought they (Corps of Engineers) had made a gross mistake and it (problem) would soon be solved. Now I can see that this is not the case.
