Judge Phillip H. Browning of the Roy 3rd Circuit Court scheduled the trial for Joseph Rocco, of the Holly Haven Apartments, No. 19, Clearfield, after hearing testimonies from two of Roccos friends, Roy Fire Chief Richard Waters and an owner of one of the destroyed buildings during a preliminary hearing Mohday. Rocco, according to his friend of eight years, Randy Carl Romero, had been drinking in Jimmys Lounge located at 5688 S. 1900 W., Roy, with him on the evening of the fire. He testified that Rocco had left the bar for a few minutes and after he had returned the fire was discovered in the building, which housed Ace Sheet Metal and H & W. Truss, in back of Jimmys Lounge. Chief Waters stated that he had observed Rocco during the fire and was able to remember him because he kept coming up to him and other firefighters asking if he could help put the fire out. Romero also testified that Rocco had tried to help the firefighters extinguish the blaze and also commented that he had appeared strange that evening. Another friend of Roccos, Kelly Hodge of Sunset, supported Romeros statement that Rocco had left the bar prior to the fire being discovered. The two witnesses differed, however, on whether Rocco had been involved in a fight before leaving the bar prior to the fire that evening.
