V; By ROSELYN KIRK A decision on i the rezone of property owned by Dale 1200 East on Hill Field Road, Layton was postponed for another two weeks after an hour and a half hour meeting on Tuesday when Davis County Commissioners decided they would need legal council before making a decision. In addition to the commission checking on the legal question, Mr. Smedley said he would do some checking himself. He will ask the Clearfield fire department whether they will contract to provide fire protection to the area. LAYTON City fire department has been contracting with the county for fire protection to that unincoi porated area, but the city now refuses to provide fire protection to industrial or commercial buildings outside of the city boundaries. Ron Layton, assistant Lay-to- n fire chief, said this decision is based on the extra equipment and expense needed to service areas outside the city. County planner Albert Cole said continuing to service this industrial area would increase the citys fire insurance and rating. commissioners COUNTY admit they are in a bind. They had given Mr. Smedley a verbal promise that if he allowed Hill Air Force Base to purchase 18 acres of property in the clear zone, that they would allow him to establish a similar number of acres with the same commercial zoning in another area. Mr. Smedley sold the property and then set up the warehousing operation in what is a 17 acre area which is zoned for agricultural use. If they allow the area to be rezoned to which would allow the warehousing development, heavy commercial developments, such as a grocery store, could move into that area. C-- ANOTHER complication is based on the action by Layton City which will leave the area without fire protection if commissioners decided to rezone the area. Layton city is attempting to force him into annexing to the city, Mr. Smedley said. In an earlier annexation hearing, Mr. Smedley and others in the area said they did not want to be annexed to the city. Another Layton annexation hearing will be held on Oct. 20. Mr. Smedley suggested the possibility of providing fire protection to the area himself since he said he has a truck with a lire pump. Environmental Health Director Rich Harvey and Mr. Layton both questioned whether the water pressure in the area would allow Mr. Smedley to fight his own fires. ASSISTANT County Attorney Mel Wilson said he would have to study the legal problem, along with County Attorney Milton J. Hess, before they could determine whether the county can contract with Mr. Smedley to provide his own fire protection. Mr. Wilson said there is no question that the city has the responsibility to provide fire protection to the unincorporated area. Mr. Smedley had suggested contracting with Hill Air Force, South Weber or Clearfield, but, after some discussion, it was agreed by the group that Clearfield Fire Department, which would have to travel about five miles to service the area, was the only real possibility. IN ADDITION to the fire protection problem, the county environmental health department and county engineer Glen Austin are con- cerned about the storm drainage problem in the area. Mr. Austin has not approved the commercial development since he says the development has created unusual surface water which seeps into other areas. Mr. Austin said that no expansion or enlargement of the present facility should be allowed until that problem is resolved. HILL Air Force Base said in a letter that if the county goes ahead and rezones, allowing more commercial development, the base wont allow a surface pond on Hill Air Force Base property to help resolve the surface water problem. Mr. Smedley said the development has not increased the surface water problem, which has always been prevalent in that area. Mr. Smedley says that he does not want to be forced into annexing the acreage area to Layton. He said that some of his additional property in that area, on which he plans residential development, will eventually be annexed. He clung to the verbal agreement made with the county com- mission. MR. COLE warned county commissioners that, if the county allows the rezoning, the development will blossom like a rose. He said if the area is rezoned, it will be up to the county to provide fire protection and other services to the area.
