Rhoades, 35, of Dove Creek, arrested in the May 29 shooting death of Carl Dillard Corky Connally, 42, also of Dove Creek, pleaded not guilty Tuesday in Seventh District Court in Monticello to second degree murder charges. A pre-tri- al examination had determined that Rhoades was mentally capable of standing trial. Duane Frandsen, Rhoades attorney, requested that Rhoades Court Report State vs Hellena Harvey, with child abuse. Case charged to rescheduled September 1. vs State Charles Lewis Gobrecht, charged with reckless driving. Judge granted motion for judgment following bail forfeiture. State vs Tom Vowell, fugitive from justice, case continued to September 1. State vs Larry R. Johns, drivunder the influence and ing driving during revocation. Case rescheduled for August 11 for be examined to determine if he was mentally sound at the time of the alleged murder. Judge Boyd Bunnell advised Frandsen that if mental stability was to be used as the basis for defense, Frandsen would have to take proper legal steps since the court could not order such an examination at this time. Trial was set for February 22, 1983. Leonard Singer, 17, found guilty of theft, was sentenced from one to 15 years in prison. Judge Bunnell stayed the sentence and placed Singer on three years probation, commenting that he was at a loss in determining the sentence since this was Singers first adult offense. Singer has a long history of juvenile offenses and corrective measures that failed. probation carries the stipulation that Singer be placed in a restrictive resident program and make restitution of almost $12,000 for the stolen truck which was Bunnell demolished. Judge to live that failure warned Singer up to terms of the probation would result in a prison sentence. The three-ye- ar work-traini- ng Civil Court granted a divorce to Colleen Wright Bryant no-fa- ult of Blanding and restored her maiden name. Loren Rogers of Blanding was granted a divorce and custody of two children. Rogers testified that his wife had deserted him. Stephen Nielson of Monticello was ordered to continue payments on the house occupied by his former wife. Nielson contended that the remarriage of his former wife and his changed financial condition warranted cancellation of house payments by him. Judge Bunnell ruled that the payments could only cease when the property was sold as stipulated in the divorce settlement and directed that immediate steps be taken to sell the house. The cases of Abajo Petroleum versus Northwest Carriers, the State of Utah versus LeRoy Duram, and Donna Larceval versus Michael Larceval were continued until the next court date. Attorney Robert Anderson, counselor for Youngs Machine Company in a case against Butt Mining Saints, and the case of Saundra Johnson versus Sandy Johnson were deferred pending out of court settlement conferences. In probate court, petition for settlement of the estate of Velma Gullet was granted. The adoption petition for Melanie Eubanks, a minor, was dismissed and the Latter-da- y Company attorney legal fees payable by Butt. Pauline Jones was awarded a divorce from Elton Jones. There were no children and settlement was arranged out of court. Defendants attorney waived preliminary hearing. Court ordered that there being probable cause that Defendant committed a crime. The Defendant is to answer charges in District Court on September 14.
