Davis Progress Editor A civil action suit has been filed against Emery County by a Castle Dale man who is suing the county for negligence In maintaining bases at the soft-ba- ll complex in Huntington. The plaintiff, James L. Farabee, claims in his suit that the county failed to properly anchor a base at the No. 1 field at the complex which resulted in an injury to his hand when he slid into the bag during a game on May 26, 1982. Mr. Farabee alleges that the base had been negligently left in disrepair and that when he slid into the base, metal pieces left under the bag resulted in the severing of the little finger of his left hand. Furthermore, Mr. Farabees suit claims that he has sustained permanent loss of function of the finger. He is asking the Seventh District Court to require the county to award him $1856.08 in medical costs and $50,000 in general damages. He also claims that he was unable to work for over six weeks and is seeking $3800 in lost wages. County Attorney Scott Johansen presented the suit to the County Commission on Nov. 2, saying that the county could either go to court or seek an nuisance settlement to avoid court costs. He said that settlement offer an should be no more than the court costs and estimated that to be $2000 at the most. However, Mr. Johansen said that his office feels good about the countys case, adding that Mr. Farabee must prove that the county was negligent in installing the base. It was also noted that the county did not carry liability insurance to cover this type of incident at the time of the accident but has since acquired such coverage. out-of-co- out-of-co- Commissioner Clyde Conover said that settling the suit out of court could set an expensive precedence and then made the motion to answer the charges in court. The motion was approved. A date for the initial hearing has not yet been set.
