Show etftf rarat space iififhM sesng pro peptylisf By GEORGE KARVEL Knight-Ridd- Newspapers ar , Before our son started col- in another city, the college !-- sketball coach gave him the me of a woman who would rent ; students. " v After she told us on the phone at the apartment was carpeted d freshly painted, we sent her a imace deposit of $780. When we to the college, we paid the first Itinth's rent and went to the apsrt-n- t. It was filthy, roach infested id unfit to live in. The landlord used to refund our $780. Is this al, or qo we neea no pursue mis 0. e - in small claims court? A. Unfortunately, there are unethical peopte in the world. Some words of advice: Never rent a home or apartment without first seeing the property. Also, before moving in, prepare a list of all damage to floors, carpets, cabinets, plumbing, furniture etc. The list should be dated and signed by the landlord. This will protect against being charged for damage you didn't cause. Inform the landlord that if your money is not returned within seven days you intend to take the following action: Inform the basketball coach of your problem. He certainly doesn't want the parents of players and students mistreated. If there is a college housing office, inform the staff mere of the failure to refund your deposit and rent. They will not want to refer parents or students to the landlord - or housing you describe. File a eompiaint with the city housing office or health department for violations of health, safe- and sanitation ty codes. Proceed to file a claim in small claims court. You may repre . sent yourself and tell your story. I believe you have a good chance of receiving part, if not all, of your deposit money. Q. I bought a piece of real estate and sold it to my son about 18 months later. Since he was just out of college and did not have a credit rating, the loan officer suggested a gift of equity. Now, the IRS is taxing me on the $17,000 transaction. What should I do? A. See a tax accountant. Depending on how the transaction was handled, you may have created a reportable sale and a taxable ,J rut A Cloud, Minn. 56302. VfWnfirt; A v" gain. The law, however, allows you to give, tax free, up to $10,000 a year. I would argue that you either gave the equity to your son or sold him the property for no more than your original purchase price. Any taxable gain doesn't exist and was used only to satisfy the lender's loan requirements.
