Show vmfl bfllodlfi - SALT LAKE CITY (AP) Fed- eral attorneys will not file criminal charges in the Wilberg Mine fire because they cannot prove criminal culpability in the underground blaze which killed 27 people Dec. 19, 1984. Assistant U.S. Attorney Paul Warner said Friday that in order to prove criminal culpability, government attorneys would have to show that any alleged criminal acts Were intentional and the suspects guilty beyond reasonable doubt. The U.S. attorney's office has decided it cannot meet those standards, and therefore has decided against filing criminal charges, Warner said. The decision came after prosecutors reviewed results of a special investigation into the disaster by the federal Mine Safety and Health Administration. Warner said the MSHA report had recommended his office file criminal charges on some, but not all the detailed allegations. '. MSHA spokesperson Katherine Snyder said her agency first conducted a routine accident investigation of the mine fire and released the results of its final report in August 1987. That report confirmed preliminary conclusions announced in March 1987 that a defective air compressor ignited the fire. As a result, MSHA fined UP&L mine-safet- violations. The final MSHA report cited 11 reasons to support its conclusions the fire originated in the air compressor, which had inoperative on-off safety re switches. Snyder said in April 1987 MSHA decided to launch the "special investigation" into concerns there may have been some criminality involved in the Wilberg fire. "Because the special investigation was entirely confidential, I am not able to discuss anything that it uncovered or what MSHA's recommendations (to the U.S. Attorney) is," she said. However, she said MSHA has the authority to conduct a special investigation in addition to its accident investigation because of provisions in the federal Mine Safety and Health Act of 1977. She said the law has provisions for both civil and criminal penalties. Regarding the civil penalties MSHA levied, Snyder said UP&L succeeded in convincing an admin-- , istrative law judge to rule that Emery Mining was solely responsible for the fines since it was the mine operator at the time. Williams in Utah and Salt Lake Counties during the annual Governor's Day recognition. Several thousand members of the Army and Air National Guard attended Saturday along with members of their families and others interested in Utah's National Guard. The governor reviewed his troops from the back of an army vehicle along with Utah's adjutant general, Maj. Gen. John L. Matthews of Provo. Bangerter told national guard members that this was his fifth year as their state commander in chief. But he said, "no matter how many times I do it, I still get a tingle up my spine. This is a great country." The governor said he had accompanied the Army National Guard on a summer mission to Honduras and learned of the critical role the guard plays in the nation's defense forces. "I came away with a new appreciation. They were making a critical difference in Honduras," Bangerter said. Governor's Day also featured a of a Utah Air National Guard KC-13-5 Stratotanker aircraft and Army National Guard helicopters. There were rides and displays for children and others who attended the annual event. The retirement of Utah's assistfly-ov- er ant adjutant general for the Army National Guard, Brig. Gen. James Martin was announced by the governor. Martin has served over 35 years. He was given the Legion of Merit award for his service. The governor said Col.
