If the amount exceeds the $5,000 limit, the claim will be sent to the Claims and Court Litigation Staff, Office of the Judge Advocate General, Washington, D.C., for waiver. For vehicles that are still in the Philippines, several choices are available. If the vehicle is serviceable, service members may request shipment of the vehicle and cost of repairs if the amount does not exceed the fair market value of the vehicle. If the repair costs exceed the fair market value and the fair market value is below the maximum payment of $5,000, the government will pay the fair market value before the volcano erupted. A duplicate set of keys should also be kept in case the vehicle is among those already shipped. A vehicle can be turned over to the Defense Marketing Organization as salvage. Repair cost or fair market value before the eruption will be awarded, whichever is less. will be paid. A vehicle may be sold to a Filipino. Service members must provide a power of attorney to an individual in the Philippines in order to make the sale. Several restrictions and cautions apply before exercising this option. This option expires Dec. 31. A claim for the fair market value may be filed if the repair cost exceeds the fair market value and the fair market value of the vehicle is less than $5,000. The claims office of the Staff Judge Advocate should be contacted as soon as possible, regardless of the option you choose. In making your claim, the following information should be ready: year, make, model color, license number and vehicle identification number, last known location of the vehicle, name and location of person who has the keys and disposition instructions for the vehicle.
