(a) D. "De minimis amount" means an amount of taxable energy that does not exceed the greater of : 1. Five percent (5) of the energy supplier's estimated total Utah gross receipts from sales of property or services; or 2. Ten thousand dollars ($10,000.00). E. "Energy Supplier" means a person supplying taxable energy, except for such persons supplying a de minimis amount of taxable energy as may be excluded by rule promulgated by the State Tax Commission. F. 'Franchise Agreement" means a franchise or an or contract, ordinance, agreement granting a franchise. G. "Franchise Tax" means: 1. a franchise tax; 2. a tax similar to a franchise tax; or 3. any combination of G.1 or G.2 subsections above. H. "Person" includes: any individual; firm; partnership; joint venture; association; corporation; estate; trust; business trust; receiver; syndicate; this state; any county, city, municipality, district, or other local governmental entity of the state; any group or combination acting as a unit, and such other entity as may be identified in Section Code Utah Annotated (1953, as amended). I. "Sale" means any transfer of title, exchange, or barter, conditional or otherwise, in any manner, of taxable energy for a consideration, including but necessaril- y limited to: 1. installment and cred- or use of taxable energy made within the City of American Fork, Utah, equalof the ing five percent delivered value of the taxable energy to the consumer. This tax shall be known as the Municipal Energy Sales and Use Tax. (5) B. The tax shall be calculated on the delivered value of the taxable energy to the consumer. C. A credit shall be, and hereby is, provided against the tax due from any consumer in the amount of a contractual franchise fee paid if: 1. the energy supplier pays the contractual franchise fee to the City of American Fork pursuant to a franchise agreement that is in effect on July 1,1997; 2. the contractual franchise fee is passed through by the energy supplier to a consumer as a separately itemized charge; and 3. the energy supplier has accepted the franchise. SECTION 3.10.060. Tax Collection Contract with State Tax Commission. A. On or before the of this effective date of the City Chapter, American Fork shall contract with the Utah State Tax Commission to perform all functions incident to the administration and collection of the Municipal Energy Sales and Use Tax, to the extent required by, and in accordance with, this Chapter and the provisions of State's the "Municipal Energy Sales and Use Tax Act". An energy supplier shall pay the Municipal Energy Sales and Use tax revenues collected from consumers directly to the American Fork City monthly if: 1. the City of American Fork is the energy supplier; or 2. the energy supplier estimates that the municipal energy sales and use tax collected annually from its Utah consumers equals one million dollars ($1,000,000) or more, and the energy collects the supplier Municipal Energy Sales and Use Tax. C. An energy supplier paying the Municipal Energy Sales and Use Tax directly to the City of American Fork may deduct any contractual franchise fees collected by the energy supplier qualifying as a credit and remit the net tax less any amount the supplier retains energy under the authority of Utah Section Code Annotated (1953, as amended) SECTION 3.10.070. Incorporation of Part 1, Chapter 12, Title 59, Utah Code Annotated (1953, as amended), Future Including Amendments Thereto. A. Except as specifically provided herein, and except as they are inconsistent with the provisions of this chapter or Title 10, Chapter 1, Part 3, Utah Code Annotated (1953, as amended) (i.e., the "Municipal Energy Sales and Use Tax Act"), the provisions of Part 1, Chapter 12, Code Title 59, Utah Annotated (1953, as amended), in force and effect on the effective date of this Chapter insofar as they relate to sales and use taxes, excepting Sections and thereof, and excepting the amount of the sales and use taxes levied therein are hereby adopted and made a part of this Chapter as if fully set forth herein. B. Wherever and to the extent that in Part 1, Chapter 12, Title 59, and in Part 3, Chapter 1, Title 10, Utah Code Annotated (1953, as amended) the State of Utah is named or referred to as the "taxing agency," "the City of American Fork" shall be substituted insofar as is necessary to effectuate the intent and purposes of those parts of the Code. Nothing herein shall be deemed to require the substitution of "the City of American Fork" for the word "State" when that word is used as part of the title of Tax Utah State the Commission, or of the Constitution of Utah; nor shall the name of the City be substituted for that of the State in any section when the result of such a substitution would require action to be taken by or against the City or any agency thereof, rather than by or against the Utah State Tax Commission, in performing the functions incident to the administration or operation of the "Municipal Energy Sales and Use Tax Act" and this Chapter. C. Any amendments hereafter made to Part 1, Chapter 12, Title 59, Utah Code Annotated (1953, as amended), which would be applicable to the City of American Fork for the purposes of carrying out this provisions and intent of this Chapter, are hereby incorporated herein by reference and shall be effective upon the date that they shall become effective as a Utah statute.
