As the result of settlement of disputed contract provisions between Air Force Logistics Command (AFLC) and the American Federation of Government Employees (AFGE), some employees may be eligible for back pay for temporary promotions held for a portion of the period 19 June 1980 through 28 June 1982. 2. The conditions under which employees may be eligible for temporary promotion are as follows: a. If, between 19 June 1980 and 28 June 1982, you were temporarily assigned to a vacant, established, bargaining unit position, at a higher grade than your permanent grade, for more than 10 consecutive days, you may be entitled to a temporary promotion beginning on the 11th day of that assignment. Following are points to keep in mind in reviewing your past work history in determining if you meet the above condition: (1) The assignment must have been to a bargaining unit position, that is, one covered under the Master Labor Agreement. Supervisory positions are not included. (2) The assignment must have been to a vacant, established position. This means you were replacing someone who formally held the position. An example might include a situation where the regular incumbent resigned or was reassigned or promoted and you replaced that person until the job was filled permanently. (3) The assignment must have exceeded 10 consecutive calendar days. (4) You must have met appropriate qualification standards for the position in question at the time of the assignment. b. If, between 19 June 1980 and 28 June 1982, Face you were temporarily assigned to an encumbered, but temporarily vacant bargaining unit position of a higher grade, for more than 30 days, you may be entitled to a temporary promotion beginning on the 31st day of that assignment. Following are points to keep in mind in reviewing your past work history in determining if you meet the above condition: (1) The assignment must have been to a bargaining unit position. (2) The assignment must have been to an encumbered, temporarily vacant position. An example of such an assignment would include filling in for someone while they were on extended sick leave or at school. The difference between this situation and (a) is that this situation refers to a position already filled by someone, but temporarily vacant because that person is temporarily absent from the job, where in (a) above the position is actually vacant; that is, no one is permanently assigned to it. (3) The assignment must have been for more than 30 consecutive days. (4) You must have met appropriate qualification standards for the position in question at the time of the assignment. c. If, between 19 June 1980 and 28 June 1982, you were assigned the full range of grade controlling duties of a higher graded position for more than 30 consecutive days, you may be entitled to a temporary promotion beginning on the 31st day. Following are points to keep in mind in reviewing your past work history in determining if you meet the above condition: (1) The duties assigned must have been from a bargaining unit position. An example would include a situation where a position is vacant and rather than assign someone to the position, the grade controlling duties are assigned to someone who is also responsible for performing their regular position. (2) The assignment was for more than 30 consecutive calendar days. (3) You must have met appropriate qualification standards of the duties in question at the time of the assignment. 3. Employees who believe they have a claim to a retroactive, temporary promotion under one of the situations described in paragraphs 2a, 2b or 2c above should do the following: a. Complete an Amendment to Personal Qualifications Statement, describing the assignment you believe fits one of the above categories and file it not later than 12 Sept. 1986. b. Identify the position to which you were assigned by some verifiable designation such as title and position number, former incumbent if to a vacancy, incumbent assigned to the position if that person was temporarily absent or some other factor which will enable us to verify your assignment. c. Have the description certified by the supervisor to whom you reported at the time of the assignment, or any supervisor having knowledge of the assignment claimed. 4. All claims will be reviewed and validated by the Civilian Personnel Office. Those accepted will be processed not later than 30 September 1986. Employees will be advised in writing of disapproved claims. Employees have the option of challenging such rejections through the negotiated grievance procedure. Any grievance must be initiated within 21 calendar days of receipt of the disapproved claim. 5. Since existing case laws, rules, and regulations limit retroactive temporary promotions to a maximum of 120 days in any period of time, all temporary promotions accomplished under this announcement will be limited accordingly. 6.
