Show Legal Notice ORDINANCE NO. 138 AN ORDINANCE confirming the assessment roll and levying levy-ing a tax providing for the assessment of property in Or-em Or-em City Special . Improvement Improve-ment District No. M for Orem City, Utah, for the purpose of paying the costs of constructing con-structing improvements on certain streets within said City consisting of grading and constructing con-structing or reconstructing curb, gutters, sidewalks, street paving, and appurtenant drainage and irrigation facilities; fac-ilities; to grade and construct con-struct driveways from curb to property line; to excavate, fill, grade, remove trees, remove re-move nonconforming improvements, improve-ments, waterways, drainage piping, inlet structures and corner intersections, and appurtenant ap-purtenant works; and to grade, drain, and do all other miscellaneous mis-cellaneous work necessary to complete the improvements in a proper workmanlike manner: to create curb, gutter, sidewalk, side-walk, and paving improvement District No. M of Orem City, Utah County, Utah, and creating creat-ing a special improvement guarantee fund and providing the time when this ordinance shall become effective. BE IT ORDAINED BY THE CITY COUNCIL OF OREM CITY, UTAH: Section 1. That the City Council Coun-cil of Orem City, Utah hereby confirms the assessment roll as corrected and adjusted by the Board of Equilization and Review Re-view for Orem City Special Improvement Im-provement District No. M for Orem City, Utah, and hereby confirms con-firms the findings of the Board of Equilization and Review that the proposed lists of assessments assess-ments as equilized by the Board of Equilization and Review are just and equitable and has not increased the amount of the proposed pro-posed assessment against any piece of property and that no assessment on the assessment list as corrected by the Board of Equilization and Review exceeds ex-ceeds the benefit to be derived from the improvements by the property as assessed and that no piece of property listed in said assessment list will bear more than its proportionate share of the cost of such improvements. Section 2. That the City Council Coun-cil of Orem City, Utah, does hereby levy a tax and provide for the 'assessment of the same upon the real property shown upon said assessment roll in the amount of assessments listed therein and upon the real property hereinafter described as being located within the limits of Orem City Special Improvement District Dis-trict No. M in and for Orem City for the purpose of paying the cost of constructing improvements improve-ments on certain streets within said City consisting of grading and constructing or reconstructing reconstruct-ing curb, gutters, sidewalks, and appurtenant drainage facilities; to grade and construct driveways drive-ways from curb to property line; to excavate, fill, grade, remove trees, remove nonconforming improvements, waterways, drainage drain-age piping, inlet structures and corner intersections, and ap-purtanant ap-purtanant works; and to grade, drain, and do all other miscellaneous mis-cellaneous work necessary to complete the improvements in a proper workmanlike manner and such other necessary construction construc-tion incidental thereto adjacent to the property hereinafter described de-scribed and abutting and fronting front-ing upon the following described streets in Orem City, Utah to wit: STREET PAVING To scarify existing pavement, pave-ment, regrade, place gravel base and pave with 1 12 inches of compacted hot plant asphalt the following streets: 1600 South Street from U. This tax is hereby levied and assessed upon each of the blocks, lots, parts of blocks and lots, lands and real estate fronting on, abutting upon or adjacent to the streets above mentioned which have been improved and which are included within the boundaries of Orem City Special Improvement District No.' M or Orem City, Utah, which boundaries are more particularly described as follows: fol-lows: BOUNDARIES OF DISTRICT Commencing 1316.87 feet east of the NE corner of Section 11, Township 6 South, Range 2 East, SLB and M; said point is also located at 1000 East and 1200 North, thence Westerly along the section line 17,317.16 feet to 1600 West Street and 1200NorthStreet; thence southerly along the section line 10,637.08 feet to 400 South and 1600WestStreet; thence easterly east-erly along the section line7,995.76 feet to 400 South and 400 West Street; thence southerly along the 14 section line 10,636.26 feet to the intersection of 400 West and 2000 South Street; thence easterly easter-ly along the section line 7,958.04 feet to the SE corner of Section 26; thence northerly along the section line 7,928.34 feet to the intersection located at 800 South and 800 East Street; thence east 1,318.70 feet; thence north along the section line 13,473.63 feet to the point of beginning. The above described boundary being within TOWNSHIP 6 South1. Range 2 East, SLB and M. The total cost of the improvements improve-ments in said Special Improve ment District is $255,533.97 (such cost being made up of the amount of interest on interim warrants, the total contract price for such improvements under contract duly let to the lowestresponsible bidder therefor, plus an amount equal to but not exceeding 10 thereof to cover the actual cost of engineering, inspection, publication pub-lication and mailing notices and making the levy), of which total cost the City's portion is $125,-176.44, $125,-176.44, leaving a balance to be assessed as-sessed to the owners of property affected or benefited by the improvements im-provements in the amount of $130,357.53, which is the total amount of the tax hereby levied and assessed. This total tax is levied at the following rates; OREM SPECIAL IMPROVEMENT DISTRICT NO. I Diive ApiufJa.-lis, Typo A 1 Drive Approaches, Type A 2 $6.45 per front foot Drive Approaches, Type B (no walk) $4.74 per front foot Concrete Flatwork $ .463 per square foot Irrigation Diversion Box $203.27 each This tax is levied and assessed at equal and uniform rates on such property and to the full depth of each parcel of real property prop-erty held in the same ownership, but in the case of any undivided tracts, not to any greater depth than the average distance subdivided sub-divided real estate is taxed for the same improvement. An allowance allow-ance on said tax has been made for corner lots so that they are not assessed at full rate on both streets. It is hereby found and determined deter-mined that the real property hereby taxed and assessed is affected af-fected by and specially benefited by the improvements which have been completed to the full amount of the tax hereby levied. The City Treasurer is hereby authorized and directed to assess as-sess the real property hereinabove herein-above referred to in accordance with the provisions of this ordinance ordin-ance for the purposes herein mentioned men-tioned and to collect said taxes as provided by law and the ordinances or-dinances of this City. Section 3. The assessment list made by the City Treasurer as corrected, approved, equalized and completed by the Board of Equalization and Review of the property described in Section 2 of this ordinance being included within Special Improvement District Dis-trict No. M for Orem City is hereby confirmed and the assessments assess-ments made and returned in said completed list and the report and recommendations of the Board of Equalization and Review to the City Council at Orem City, Utah, are hereby ratified, approved and confirmed. Section 4. The whole or any part of the tax may be paid without with-out interest within fifteen (15) days after this ordinance becomes be-comes effective. Interest shall be paid in addition to the amount of each such installment at the time each installment becomes due. All unpaid un-paid installments of an assessment assess-ment levied against any piece of property (but only in their entirety) en-tirety) may be paid prior to the dates on which they become due, but any such prepayment must include an additional amount equal to the interest which would accrue on the assessment to the next succeeding date on which interest is payable on the bonds issued in anticipation of the collection col-lection of the assessment plus such additional amount as, in the opinion of the City Treasurer, Treasur-er, is necessary to assure the availability of money to pay interest in-terest on the special improvement improve-ment bonds as interest becomes due and any premiums which may become payable on redeemable redeem-able bonds which may be callec in order to utilize the assessments assess-ments thus paid in advance. The City Council of Orem City, Utah, does hereby create a special improvement guaranty fund and shall at the time of each annual appropriation appropria-tion ordinance, so long as any special improvement district bonds of Orem City remain outstanding, out-standing, provide for the levying of a tax of one mill in each year to create a fund for the purpose of guaranteeing to the extent of such fund the payment of special improvement bonds or warrants and interest thereon issued against local improvement districts dis-tricts for the payment of local improvements therein, all in the manner and to the extent provided pro-vided by the laws of the State of Utah. Section 6. The City Council of Orem City, Utah, is hereby authorized to issue special improvement im-provement bonds in payment of the costs and expenses of such local improvements aginst the funds created by the assessment. assess-ment. Section 7. That the officials of Orem City, Utah, be and they are hereby authorized and directed dir-ected to take all action necessary or appropriate to effectuate the provisions of this ordinance. Section 8. That all ordinances or parts thereof in conflict with this ordinance are hereby repealed. re-pealed. That an emergency is hereby declared, the preservation preser-vation of peace, health and safety of Orem City and the inhabitants thereof so requiring, that immediately im-mediately after its adoption this ordinance shall be signed by the Mayor and City Recorder and shall be recorded in the ordinance book kept for that purpose, and said ordinance shall be published once in the Orem-Geneva Times, a newspaper of general circulation circula-tion in Orem City, Utah, and this ordinance shall take effect immediately im-mediately upon its passage and approval and publication as required re-quired by law.
