Show LEGAL NOTICE ORDINANCE 108 AN ORDINANCE PROVIDING FOR THE ASSESSMENT OF OF THE PROPERTY IN SPECIAL SPEC-IAL IMPROVEMENT STREET LIGHTING DISTRICT NUMBER 6, IN OREM CITY, UTAH, AND LEVYING A SPECIAL TAX THEREON, FOR THE PURPOSE PUR-POSE OF PAYING THE COST OF THE CONSTRUCTION OF THE IMPROVEMENTS DESCRIBED DE-SCRIBED THEREIN. THE COUNCIL OF OREM CITY HEREBY ORDAINS: SECTION 1. There is hereby levied a tax which is assessed upon the property hereinafter described de-scribed in Special Improvement Street Lighting District Number 6, for the purpose of constructing, construct-ing, maintaining, patroling, operating, oper-ating, and furnishing with electric elec-tric energy for a period of ten (10) years, fifty-two (52) 4,000 lumen incandescent lamps to be operated on an all night schedule for a period of ten years from February 25, 1966, to February 25. 1976. in a special improve ment district known as Special Improvement Street Lighting District Dis-trict Number 6 over and upon the following described streets in Orem, Utah, Utah, to-wit: On the west side pf 800 East at 1302 South. On the west side of 800 East at 1340 South. On the west side of 800 East at 1364 South. On the southwest corner of 800 East at 1400'South. On the west side of 800 East at 1442 South. On the west side of 800 East at 1472 South. On the southwest corner of 800 East at 1500 South. On the west side of 800 East at 1544 South. On the west side of 800 East at 1584 South. The tax is levied to defray the expense of constructing the above described Improvements over the upon the above described streets in front of the property hereinafter described, to be especially es-pecially affected and benefited by such improvements, and it Is hereby adjudged and determined that said property will be especially es-pecially affected and benefited by such improvements, and it is i hereby adjudged and determined that said property will be especially espec-ially benefited thereby to the full amount of the taxes herein levied; and said tracts and parcels of land are hereby assessed with the linear foot frontage upon said streets to full depth of said lot or land up to and including 120 feet back from the property line of the various portions of said streets upon which the same abut or are adjacent, or benefit. The said assessment hereby made is at an equal and uniform rate for the construction of said improvements. im-provements. The foregoing described property prop-erty and the boundaries of the said Special Improvement Street Lighting District No. 6 are all located within the corporate limits lim-its of Orem City, Utah. SECTION U. The total tax hereby here-by levied and assessed upon the above described lots and parcels of property in said District is the sum of $25,396.80, the said a-mount a-mount being the cost of the a-butters a-butters and property owners portion por-tion of said improvements therein, there-in, according to the contracts entered en-tered into for the performance of said work and the making of said improvements by Orem City with Utah Power and Light Company, together with the cost of advertising, ad-vertising, inspection, mailing notices, engineering and miscellaneous miscel-laneous services performed in connectin with the construction work under said contract and added thereto as provided by law and ordinance. The tax hereby levied and assessed as-sessed against the abutting lots and parcels of land and lands benefited thereby in said district, dis-trict, is at the following uniform rates per front linear foot of abutting property opposite which said improvements have been constructed, to-wit: SPECIAL IMPROVEMENT STREET LIGHTING DISTRICT DIS-TRICT NUMBER 6 ITEM Fifty-two (52) 4,000 lumen incandescent in-candescent lamps operated on an all night schedule for a period of ten years from Fed-ruary Fed-ruary 25, 1966, to February 25, 1976. The aforesaid rates uniform as to property affected thereby and in accordance with the benefits accruing to each such property, all of which is shown on the lists and plat on file in the office of the Orem City Engineer; that same having been adjusted and corrected have been approved and determined to be uniform and in proportion to the benefits accruing ac-cruing to each such property, by the Board of E qualization and Review Re-view of said District Number 6 in Orem City. SECTION HI. That the asses-ment asses-ment lists made by the Orem City Engineer, as approved by the Board of Equalization and Review of the property described inSec-tion inSec-tion 1 of this ordinance inSpecial Improvement StreetLightingDis-trict StreetLightingDis-trict Number 6 of Orem City, Utah, recommending the assessments assess-ments to be made in accordance with the said lists, except for certain adjustments and allowances allow-ances recommended by the Board of Equalization and Review of Orem City which this council of Orem City finds to be fair and equitable and which is hereby approved, and finding and deter mining, that no lot, parts of lots. or parcels of property and real estate in said District was assessed as-sessed more than its respective proportionate share of the cost, of the improvements and benefits bene-fits be, and the same is hereby ratified, approved, and confirmed. confirm-ed. SECTION IV. The Orem City Treasurer is hereby authorized and directed to assess and collect col-lect the said tax hereby assessed against the several properties lo- j cated in said District No. 6, in accordance with the provisions of this ordinance and for the purpose pur-pose herein mentioned. Said tax shall be payable in ten equal yearly installments, the first of which is due February 25, 1967, and thereafter on the same date each year until the ten installments install-ments have been paid, as provided by law and ordinance, with interest in-terest on the whole sum unpaid balance from date of February 25, 1966, payable at the time each Installment is due. Provided, however, that one or more of such Installments in the order payable, or the whole tax, may be paid without interest within 15 days after this ordinance becomes be-comes effective. One or more installments in-stallments in order in which they I are payable, or the whole special tax, may be paid on the day any installment becomes due by paying the amount thereof and interest in-terest to the date of payment. Default in the payment of any such installment of principal or interest in-terest when due shall cause the whole of the unpaid principal and Interest to become due any payable pay-able immediately, and the whole amount of the unpaid principal shall thereafter draw interest at the rate of ten per cent (10) per annum until paid, or until the sale of the property assessed as provided by law, but any time prior to the date of the sale of said property, the owner may pay the amount of all unpaid installments install-ments past due, with 10 interest to date of payment on the delinquent delin-quent installments and all accrued ac-crued costs, and shall thereupon be restored to the right thereafter there-after to pay installments, in the same manner as if the default had not occured. SECTION V. The Orem City Recorder, upon final passage of this ordinance, shall forthwith deliver to the Orem City Treasurer Treas-urer certified copies of said lists and plat, the Resolution appointing ap-pointing the Board of Equalization and Review, Notice of the Meeting Meet-ing of said Board and of said ordinance showing the levy of such tax, and thereupon the Orem City Treasurer shall, without delay, de-lay, give at least five days notice by publishing same once in the Orem-Geneva Times, a newspaper news-paper published weekly and of general circulation inOremCity, Utah, of the tax assessed hereby and stating the time when said tax shall become delinquent; and that as soon as possible after said publication of said notice by causing caus-ing a notice to be deposited in the United States mail, postpaid, and in separately addressed envelopes en-velopes to the several owners of the property as shown on the tax lists containing the facts relating relat-ing to the assessment substantially substan-tially in the form provided for the published notice. SECTION VI. It being deemed necessary for the immediate preservation pre-servation of the peace and health and safety, of Orem City, Utah, and its inhabitants that this ordinance ordin-ance become effective immediately immedi-ately upon its publication once in the Orem-Geneva Times a newspaper of general circulation published weekly in Orem City, Utah.
