Of the Record staff Over two years after an accident acci-dent occurred involving South Summit School District bus driver Dixie Thompson and Kamas resident resi-dent Wendy Ann Moench, a personal per-sonal injury suit has been filed by Moench against Thompson and the district. According to documents filed in Third District Court, Moench was driving east on State Route 248 on Jan. 22, 2002 around 12:30 p.m. Thompson was driving a district dis-trict bus heading south on Democrat Alley toward SR248 and failed to stop at a stop sign located on the road and yield the right-of-way to Moench 's vehicle. According to the lawsuit, a collision colli-sion occurred between the two vehicles, injuring Moench, primarily prima-rily on the right side of her body, including her neck, ribs and spine, right arm and thumb, knee and head, as well as cuts and abrasions. abra-sions. The suit says Thompson "negligently, "negli-gently, carelessly and recklessly" failed to stop and in doing so, caused ' the accident. Since Thompson was driving the bus during work hours, the district was named in the suit. Also named as defendants in the suit are one to five "John Does" or people whose identities are unknown, but will be determined. District Superintendent Tim Smith says he has not seen the suit. "We understand that it's been filed, but it has not come to us yet," said Smith. Smith added that the matter was turned over to the district's insurance carrier two years ago. "I dont know whether it's with risk management or not. I'm at a loss right now," he said. Thompson remains employed as a bus driver with the district. She was unavailable to comment on the suit at press time" Moench and her attorney, Wilford Beesley, 1 Sr. of Beesley & Fairclough were also unavailable for comment. The amount sought in the suit is "not less than $500,000" for physical and emotional pain, suffering, suf-fering, anxiety, hypertension, hospitalization hos-pitalization and medical treatment, treat-ment, which to date total roughly $36,800. Damages include past, present and future medical expenses, loss of wages, "probable loss" of earning capacity and general gen-eral damages, including court costs. The suit claims that Moench has permanent injuries, her knee is disfigured and she will require additional medical treatment. Smith says the suit will most likely be settled. "There's probably going to be a settlement," said Smith. CHIP open enrollment is next month The Utah Department of Health (UDOH) will be accepting accept-ing applications for CHIP (Utah's Children's . Health Insurance Program) during open enrollment, May 3 to 12, 2004. Spring is a great time to enroll your kids on CHIP. The UDOH will accept all eligible Utah children who apply during this open enrollment session. CHIP is a health insurance plan for children funded jointly by the federal and state governments. govern-ments. To receive CHIP, children must qualify based on family size and household income. For example, a family of four earning up to $37,700 a year may qualify. In addition, children must also be younger than 19, U.S. citizens or legal residents, and not cur- rently covered by health insurance insur-ance to qualify. Once enrolled on CHIP, families may be required to pay premiums of up to $25 every three months. Premiums and small co-pays make it possi ble for CHIP to insure more children. chil-dren. Since 1998, CHIP has covered nearly 71,000 Utah kids. Today enrollment is at just over 25,000 children. The dates and length of open enrollment periods are determined by how many children chil-dren enroll, the number who leave the program, and available funding. "As a pediatrician, I know how much it puts parents at ease to have their children covered by health insurance and how much it helps their doctors to be able to provide good health care for them." "My son Taylor has asthma," says Kristi Allred, CHIP mom and CHIP Advisory Council member. "Having CHIP means Taylor's asthma is treated so he can play baseball and other sports this spring." The UDOH will conduct "A Good Call for Kids" media campaign cam-paign featuring children who have benefited from CHIP during dur-ing April and May. Outreach will also be conducted via community partners, including includ-ing schools, child care agencies, and advocacy groups. Unbuckled parents mean unbuckled kids If we want to protect children we need to do more to reach adults who don't wear their safety belts. Why? A recent child safety seat study by . the National Highway Traffic Safety Administration (NHTSA) reveals that an alarming number of unbuckled adults don't buckle their kidsdespite. laws that man- date child restraint use and common sense that kids should be properly restrained in a car seat and booster, seat that are proven to save lives. The NHTSA study confirmed that when a driver was wearing a safety' belt, 91.7 percent of the children (weighing 80 pounds or less) were restrained in either a child safety seat or safety belt. But when the driver was not wearing a safety belt, the percentage percent-age of children who were restrained dropped to 62.3 percent. per-cent. This is unacceptable. Adults who do not wear their safety belts cannot risk the lives of children who ride with them. Those drivers need only a few extra seconds to make sure that the kids in their vehicles are properly restrained. Moreover, in the interest of the child, adults must buckle themselves as well.
