We want to become a part of the community." But to local residents, MRI is more than a fulfillment of a promise, it is a significant resource to be utilized. Minor controversy arises over ordinance continued from D1 department feels Tesch's concerns are unfounded, and that the ordinance as it currently reads is an acceptable middle ground for Park City, somewhere between puritanical and "anything goes." "I'm not sure what some of his specific constitutional concerns are." said Mark Harrington, assistant Park City attorney and the individual who drafted the ordinance. "We disagree with Tesch's assertions. We have taken these definitions from constitutionally tested ordinances." In a community that is sometimes somewhat permissive in its thinking, Harrington said the object was to draft an ordinance with common ground. Nevertheless, the i ordinance has received opposition both from those who feel it is either too permissive or too lenient. "We thought this was a good compromise between competing interests, the libertarians on one side and a bedroom community on the other," Harrington said. "We've made the definitions apply as narrowly as we feel necessary." As for some of Tesch's specific-concerns, specific-concerns, Harrington said the definition of an 'adult theater' could not apply to Holiday Village, because it refers to a theater in which children are absolutely prohibited from entering, saying nothing about parental supervision. "That does not apply to R-rated films, which he (Tesch) should know better than to imply," said Harrington. Apparently, Tesch's actions have had the desired effect, as the Park City Council will review the issue with public comment on Aug. 31. "Justice is applied evenly," said Tesch, adding that exceptions aren't made in court if something is in violation of a certain ordinance. No judge is going to say, "Yeah, but it's art." "Either it's prohibited activity or it's not," Tesch added. Still, Harrington and the legal department feel further discussion is just re-hashing an old issue. Can't get a clue about what to do?
