NOTICE OF PUBLIC HEARING AND BONDS TO BE ISSUED NOTICE IS HEREBY GIVEN pursuant pur-suant to the provisions of the Local Building Authority Act, Title 17D, Chapter 2, Utah Code Annotated 1953, that on October 29, 2007, the Governing Board (the "Board") of the Municipal Building Authority of Uintah County, Utah (the "Issuer") adopted . a 'parameters resolution resolu-tion (the "Parameters Resolution") in which it authorized the issuance issu-ance by the Issuer of its Lease Revenue Bonds, in multiple series (the "Bonds") in the aggregate principal prin-cipal amount of not to exceed Filly Million Dollars ($50,000,000), to bear a maximum interest of 7.5, to mature in not more than thirty-five (35) years from their date or dates, and to be sold at a price not less than ninety-seven percent (97) of the total principal amount thereof. The Bonds, pursuant pursu-ant to the Parameters Resolution and a form of Authorizing Resolution (collectively, (collective-ly, the "Resolution") to be adopted authorizing autho-rizing and confirming Vernal Express the sale of the Bonds are being issued for the purpose of (i) financing public safety safe-ty facilities and related relat-ed improvements for use by Uintah County or its designee; (ii) funding a debt service ser-vice reserve fund or surety, if desirable, and (iii) paying issuance issu-ance expenses on the Bonds. A Notice of Bonds to be Issued was published pub-lished on November 7, 2007. A Notice of Public Hearing and Bonds to be Issued was published on April 16 and April 23, 2008. Effective May 5, 2008, new statutory provisions apply to the issuance of bonds by the Issuer. To assure compliance with the new statutory provisions, the Issuer provides this additional addi-tional notice and calls a public hearing with respect to the Bonds. NOTICE IS FURTHER GIVEN that the Issuer calls a public hearing for July 7, 2008, at 11:00 a.m., or as soon thereafter there-after as feasible, in the County Commission Chambers at 147 East Main in Vernal, Utah to receive input from the public with respect to the issuance of the Bonds and the potential poten-tial economic impact that the public safety facilities and related improvements will have on the private sector. The maximum amount, interest rate, maturity, and discount on the Bonds will be as set forth above. As lease revenue obligations, obliga-tions, no taxes are proposed pro-posed to be pledged for repayment of the Bonds. The Bonds are to be issued and sold by the Issuer pursuant to the Parameters Resolution and this notice, including includ-ing as part of said ParametersResolution, a form of Authorizing Resolution and a form of Master Resolution or Indenture (collectively, (collec-tively, the "Final Bond Resolution") to be adopted by the Issuer in such form and with such changes thereto as shall be approved by the Issuer upon the adoption thereof; provided that the principal prin-cipal amount, interest rate or rates, maturity and discount of the Bonds will not exceed the maximums set forth above. The Resolution replaces and supersedes super-sedes the Issuer's resolution adopted on February 14, 2007 and the notice authorized therein. NOTICE IS FURTHER GIVEN that the Issuer called a public hearing for July 9, 2008, at 7:30 p.m. or as soon thereafter as feasible, to be held at LaPoint Elementary School at 10752 E 6900 N in LaPoint, Utah. At the public hearing the Issuer will receive public input regarding the proposed pro-posed issuance of the Series 2008 Bonds and on the economic impact on the private sector of the improvements improve-ments to be financed by the Series 2008 Bonds. The Series 2008 Bonds will be issued pursuant to the Resolution and a Final Bond Resolution to be adopted authorizing and confirming the sale of the Series 2008 Bonds (the "Final Bond Resolution") for the purposes of (i) financing the cost of constructing improvements improve-ments to the Issuer's water system, including includ-ing construction of a new water treatment facility, and related improvements, and (ii) paying the costs of issuing the Series 2008 Bonds. As water' revenues bonds, no taxes will be pledged for repayment of the Series 2008 Bonds. A draft ' of the Resolution and the Final Bond Resolution in substantially final form was before the Governing Board and was part of the Resolution at the time of the adoption of the Resolution by the Governing Board. The Final Bond Resolution is to be adopted by the Governing Board in such form and with such changes thereto as shall be approved , - by " the Governing '-Board '-Board upon the adop-tion adop-tion thereof; provided that the principal amount, interest rate or rates, maturity and discount of the Series 2008 Bonds will not exceed the maximums set forth above. NOTICE OF PUBLIC HEARING AND BONDS TO BE ISSUED PUBLIC NOTICE IS HEREBY GIVEN that on June 12, 2008, the City Council (the "Council") of the City of Naples, Utah (the "Issuer"), adopted adopt-ed a resolution (the "Resolution") declaring declar-ing its intention to issue Excise Tax Road Bonds, Series 2008 (to be issued in one or more series and with such other series or title designation(s) as may be determined by the Issuer) (the "Bonds") pursuant to the Local Government Bonding Act, Title 11, Chapter 14, Utah Code Annotated 1953, as amended, and to call a public hearing to receive input from the public with respect to the issuance of the Bonds. TIME, PLACE AND LOCATION OF' PUBLIC HEARING The Issuer shall hold a public hearing on July 10, 2008, at . the hour of 7:30 p.m. The location of the public hearing is at the Naples City Offices at 1420 East 2850 South, Naples, Utah. EXCISE TAXES PROPOSED TO BE PLEDGED The Issuer proposes to pledge all the class B and class C road funds received by the Issuer pursuant to Title 72, Chapter 2, Part 1, Utah Code Annotated 1953, as amended, for repayment repay-ment of the Bonds. The Bonds are to be issued and sold by the Issuer pursuant pursu-ant to the Resolution, including as part of said Resolution the draft of a Final Bond Resolution which were before the Council and attached to the Resolution in substantially final form at the time of the adoption of the Resolution and said Final Bond Resolution is to be adopted by the Council in such form and with such changes thereto as shall be approved by the Council upon the adoption thereof; provided pro-vided that the principal princi-pal amount, interest rate or rates, maturity and discount of the Bonds will not exceed the maximums set forth above.
