Show Annexation decision tabled again i By DON ETA GATHERUM LAYTON A decision on the annexation of unincorporated acreage lying between Layton and Clearfield was tabled by the Layton City Council for the second time last Thursday evening until the Layton Council can meet with the Clearfield City Council to see if some annexation agreement can be reached. The petition for annexation to Layton was submitted to Layton by Blake Hazen and Ed Green. They want to develop a single fami- ly subdivision on 73 acres of property prop-erty at 2800 West Gordon Avenue. The established boundary line between be-tween Layton and Clearfield is Gordon Ave. In 1979 when Layton annexed property along West Gordon Avenue, Ave-nue, Clearfield filed with the court system to stop the annexation. Although the matter never went to court, negotiations between the two cities resulted in the filing of a court document that contains the stipulation that before Layton annexes any property north of Gordon Gor-don Avenue, it must receive the permission of the Clearfield City Council. The council held a public hearing on April 2 1 to consider the annexation annexa-tion petition. A decision was postponed post-poned because the Clearfield City Council had not given any imput concerning the annexation. The council again considered the question ques-tion last Thursday evening. This allowed the Clearfield Council time to meet and make a statement about ab-out the annexation. Thursday afternoon, Clearfield City Manager, Wally Baird, delivered deli-vered a letter to Mayor Richard McKenzie from the Clearfield Council. It stated Clearfield was not in favor of the annexation. All indicated they wanted to be annexed to Layton. Sam Chelemes stated that the land owners had never been consulted con-sulted when the 1979 agreement was drawn up. "There is no way Clearfield can service that property proper-ty for more than 200 feet off Antelope Ante-lope Drive. Gordon Avenue has al-ways al-ways been associated with Layton," Mr. Chelemes observed. Paul Roberts, owner of the property prop-erty involved in the annexation request, re-quest, said he attended the Clearfield Clear-field City Council meeting and told them he wanted his property annexed to Layton. Mayor McKenzie stated this is not a "conflict between Layton and Clearfield. We just want to honor the desires of the property owners. There is not enough land in this area to create a kingdom for Layton. Still, I see a host of problems prob-lems that would make it difficult for Clearfield to move into this area." According to Layton's Community Com-munity Development Director, Scott Carter, the 73 acres involved in the annexation petition is a portion por-tion of about 500 acres lying between be-tween Layton and Clearfield in the unincorporated county. "Annexation "Annexa-tion decisions are usually based on the desires of the property owners and the abilities cities have to deliver de-liver services into the area," Mr. Carter said. The Layton council hopes to set up a meeting with the Clearfield council to work out a solution to the problem. The annexation public hearing was continued until May 19 at 7:35 p.m. |
