Johnson asked him if he had told the Health Board that the Commission had disapproved a Vital Statistics Sta-tistics Department when Larson had first requested it, on the basis that it was expensive, and a duplication of state efforts. Larson admitted ad-mitted he had not pressed the point. The Commission again refused to endorse the proposal. Phyllis Symond told the Commission that all welfare grants had been cut October 1st. She said that the only problem she anticipated was in helping transients, but that she didn't know if it would be necessary for the county to accept more responsiblity in this area yet. County Health Nurse Lind-ley Lind-ley Jefferson, and Gail Webster, Web-ster, who has assisted her on the Wic program both resigned. They gave as reasons, boredom with the job and a desire to do other things. Jefferson will continue con-tinue as school health nurse. They recommended the WIC program be dropped. The WIC contract was up Oct. 1st, and theCommission voted vot-ed to drop it immediately. It was agreed to advertise for a new county health nurse. John Williams, FCAG Di rector requested funding approval ap-proval for ColorCountyAdv. $2698, Title 201 Planning, $562.50 and Economic Development De-velopment District, $2000. Since the Adv. Matching funds had already been approved, ap-proved, it was moved and passed to approve $2,562.50 for the other projects. The claims were denied first on the basis that the county had no liability, lia-bility, and second that no justification had been shown for the amount of the damages or special damages. dam-ages. Claims had been filed for a total of $4.2 million dollars by heirs of LaRue Rowley, Helen Cook, Verna Tomsik, Clinton and Vera Bond and Florence Myers, and for William LeRoy Myers, My-ers, who was injured in the accident. The charges were leveled by Lee Oertle, in behalf of himself and several other property owners in the Canyon Breeze Subdivision. The problem lies in the fact that three irrigation ditches run through the subdivision, sub-division, bisecting several lots. Larson's interpretation, interpreta-tion, according to Oertle, is that septic tank drain fields cannot run . closer than 100 feet to irrigation ditches. ditch-es. Oertle said that when the subdivision was approved, they were told that drain fields, or construction could be approved within 30 feet of ditches. Oertle saidthat while Larson Lar-son had told several lot owners own-ers they could not build, he (Larson) had himself issued is-sued a permit on lots 4 and 5, Block C, to Bill Floyd. Oertle said the distance from the ditch to the street is only 100 feet on the Floyd property, therefore no part of the project could be 100 feet from the ditch. Oertle said that 31 lots in the Canyon Breeze Subdivision Subdiv-ision are cornered or divided divid-ed by one ditch or another. With Larson's interpretation of the State Health Code, 46 of the lots in the subdivision sub-division would be rendered unusable. Larson was asked to produce pro-duce the code he was using for reference. Upon his return, he admitted the regulations regu-lations were new and not yet adopted. He argued that they still should be followed. He made no explanation as to why he had issued Floyd's permit, while refuslngslmi-lar refuslngslmi-lar permits. Oertle said all lots sloped away from the canals, and there was nothing in the original deed restrictions on this matter, other than street setbacks. He said the subdivision sub-division plans were examined examin-ed and approved by the State and Beaver County. He said the same ditches pass through Beaver with no obvious ob-vious problems, though in some instances homes are closer than 30 feet.
